Little guidance from Washington and a flood of new nonprofits left the Cincinnati office overwhelmed.

WASHINGTON — Steven Miller, the top enforcement official at the Internal Revenue Service, thought he might have trouble on his hands.

Election season was well underway in March 2012 when tea party organizations started to complain angrily of IRS harassment over their requests for tax-exempt status. The media was looking into it. Congress had picked up the scent.

Miller dispatched an advisor to Cincinnati, where a field office handles applications from nonprofits, to figure out what was up. What he learned would blow up into a crisis that would damage the agency’s reputation and lead to his ouster last week.

With little oversight from Washington, agents in Ohio had been singling out some conservative groups for extra scrutiny, seeking to make sure they were not too heavily involved in politics to qualify as tax-exempt.

Worse yet, the agents had sent the organizations letters with numerous intrusive questions, including the groups’ positions on political issues and the names of their donors.

Miller failed to tell Congress what he knew for more than a year, despite repeated queries from House committees. On Friday, at times chagrined and combative as he spoke to House members, Miller called the IRS’ focus on conservative groups “obnoxious” and described what happened as “horrible customer service.”

No evidence yet suggests that the IRS agents in Cincinnati had a political agenda. But ample evidence has emerged in congressional testimony and in an inspector general’s report that they were overwhelmed by an influx of applications from new politically oriented nonprofits. At the same time, they were left to fend for themselves, unsupervised by Washington managers who never created rules on how to evaluate the new groups.

“Cincinnati basically became an island of its own out there,” said Paul Streckfus, a former IRS attorney. He suggested the missteps and clumsy response stemmed from a “hidebound” and insular culture at the IRS. “They don’t trust outsiders,” he said. “They know they’re always under attack, and they have a bunker mentality: ‘If we keep our heads down long enough, we will survive the latest onslaught.’”

The scandal, which appears to have started with one specialist in Cincinnati, was slow-building, born of a dysfunctional bureaucracy and a fateful reorganization years ago that placed more authority in the hands of accountants and lawyers 500 miles from headquarters in Washington.

“In my view, there was a failure of management in D.C. to get their hands around this early enough,” said Marvin Friedlander, who retired in 2009 after 41 years with the IRS. “Cincinnati should have reached out to Washington headquarters people, and Washington should have gotten ahead of the curve.”

The inquiry has put a spotlight on an obscure branch of the IRS, the Tax Exempt/Government Entities Division, which is largely housed in an office building in downtown Cincinnati.

Former employees describe staff in the Cincinnati office as well-intentioned but overworked, struggling to keep up with more than 60,000 applications a year from groups that want to be classified as tax-exempt, such as churches, chambers of commerce, PTAs and advocacy groups.

The applications are reviewed by about 200 people in a “determinations unit,” about 140 of those in Cincinnati. To keep ahead of the flood, former employees say, the staff frequently resorts to shortcuts.

“That office is given direction to move as quickly as possible, but also be accurate,” said Philip Hackney, an assistant law professor at Louisiana State University who worked in the IRS chief counsel’s office from 2006 to 2011. “It’s impossible. They miss a lot of stuff.”

The agency has had to work with a smaller staff — overall, the exempt division has about 860 people, Miller told Congress last year, down nearly 10% from its peak. Once, lawyers from national headquarters regularly compiled briefings on emerging issues and conducted weeklong training sessions in Cincinnati. But those were scrapped in 2004.

In years past, the office had spent little time worrying about so-called social welfare organizations formed under section 501(c)4 of the tax code, instead focusing more attention on charity groups.

But that changed in 2010, after the Supreme Court’s decision in Citizens United. Political operatives stepped up their use of social welfare groups as vehicles to spend hundreds of millions to shape the outcome of elections — all of it from hidden sources. Social welfare organizations are not required to reveal their donors, unlike political committees.

To qualify, however, such groups cannot have politics as their “primary purpose.” But the rules don’t say how much political activity is too much. That fraught issue was left in the hands of agents with mostly accounting backgrounds who were ill-suited to deal with questions of politics and the 1st Amendment.

In the past, former employees said, similarly tricky situations would have been kicked up to IRS lawyers in Washington. That changed after an IRS reorganization a decade ago.

“The concern was that the lawyers in D.C. had other work to do, and Cincinnati should be able to handle most or all of the cases,” said Friedlander, a former branch chief in the exempt organizations division.

Letters from the IRS to tea party-related organizations in Oklahoma City and Albuquerque, New Mexico show that IRS headquarters in Washington, D.C., and two satellite offices in California, were directly involved with sending harassing letters to conservative organizations that sought tax-exempt status.

The IRS has acknowledged only the involvement of its Exempt Organizations office in Cincinnati, Ohio, which typically makes most decisions about granting or denying tax-exempt status to non-profit organizations.

And Wednesday afternoon, CNN cited a congressional source in reporting that the acting IRS Commissioner – whom President Obama fired later in the day – had identified two ‘rogue’ employees, both in Cincinnati, whom he thought were responsible for targeting right-wing organizations with tactics that were not applied to left-wing or non-political groups.

Steven Miller then the acting IRS Commissioner, described the two employees as being ‘off the reservation,’ according to the CNN source.

Miller, added CNN, had emphasized that the problem was not confined to just two staffers.

Tuesday’s report from the IRS Office of Inspector General, however, focused exclusively on the Cincinnati office.

This IG’s review, according to the report ‘was performed at the EO [Exempt Organizations] function Headquarters office in Washington, D.C., and the Determinations Unit in Cincinnati, Ohio.’

The Washington staffers involved, the IG report continues, were in charge of reviewing materials prepared in Cincinnati. ‘As part of this effort, EO function Headquarters office employees reviewed the additional information request letters prepared by the team of [Cincinnati] specialists,’ the report reads.

Nothing in the report describes letters sent by IRS employees in California or the District of Columbia.

Yet an April 21, 2010 letter to the Albuquerque Tea Party organization, containing a preliminary list of 10 questions, came from the IRS’s Tax Exempt and Government Entities Division in Washington, D.C. The group responded on June 10.

Seventeen months passed before the IRS responded on November 16, 2011. That letter, similar in scope and tone to other intrusive IRS letters that have drawn national attention, also came from the Washington, D.C. IRS office. It included an additional 28 questions.

A separate letter came to Patriots Educating Concerned Americans Now (PECAN), a Redding, California conservative group, from an IRS office in the Orange County, California town of Laguna Niguel.

That letter, dated January 31, 2012, asked 55 questions, including a demand for ‘complete copies of the organization’s website that is accessible to members only.’

It also asked a series of pointed questions about PECAN’s relationship to the Redding Tea Party Patriots, an overtly political organization.

A third IRS letter to a group called Oklahoma City Patriots In Action, or the OKC PIA Association, came from an IRS office in El Monte, California, an eastern suburb of Los Angeles, on February 9, 2012.

It included 59 questions, including a demand for a list showing the time, date, place and ‘content schedule’ for every ‘public rally or exhibition’ the group had ever conducted.’for or against any public policies, legislations [sic], public officers, political candidates, or like kinds.’

‘Please state whether you provide any advocacy training to your members and to the general public,’ another question read. ‘If yes, describe in detail your advocacy training and provide copies of any publications concerning such training.’

The American Center for Law and Justice (ACLJ), which represents all three groups, provided MailOnline with a letter from the IRS in Washington, D.C. in which the agency said it still had not decided whether to award the Albuquerque Tea Party tax-exempt status.

That letter was dated April 16, 2013, more than three years since the group filed its initial application.

Jay Sekulow, the ACLJ’s chief counsel, scoffed at the idea of the IRS scapegoating a pair of its Cincinnati employees, given the letters he has seen from offices three time zones apart.

(WASHINGTON) — The Air Force’s top general said Friday that sexual assaults in his branch of the military typically involve alcohol use and can be traced to a lack of respect for women.

“We have a problem with respect for women that leads to many of the situations that result in sexual assault in our Air Force,” Gen. Mark Welsh told reporters in a lengthy interview in his Pentagon offices.

He spoke one day after he and other military leaders were summoned to the White House to discuss the sexual assault problem with President Barack Obama, who has expressed impatience with the Pentagon’s failure to solve it.

Welsh said combatting the problem, which he characterized as a crisis, is his No. 1 priority as the Air Force chief of staff. He said he reviews every reported case of sexual assault; last year there were 792 in the Air Force.

Welsh addressed criticism about his comment last week, in response to questions at a congressional hearing, that the problem can be explained in part by a “hook-up mentality” in the wider society. Some said his remark implied that the blame rests mainly with victims.

“If I had this to do over again, I would take more time to answer the question and not try to compress it,” he said, adding that his point was that every person who enters the Air Force needs to be instructed in “this idea of respect, inclusion, diversity and value of every individual.”

“Now, I didn’t say it that way in the hearing, and I wish I had because I think it gave, especially victims, the opportunity for someone to interpret what I said as blaming the victims,” he said, adding that as a result, “I am sorry about that because there is nothing that is farther from the truth.”

Obama said after Thursday’s meeting with the military leaders that he is determined to eliminate the “scourge” of sexual assault in the military, while cautioning that it will take a long and sustained effort by all military members.

“There is no silver bullet to solving this problem,” Obama said.

WASHINGTON — As the president continues to press top military brass to stop sexual assaults and a third man in charge of sexual assault prevention is accused of misconduct, the Air Force chief of staff said he’s open to doing what advocates have been suggesting for years: Removing the authority to prosecute sex crimes from the chain of command.

Currently, commanders are responsible for initiating courts-martial against alleged attackers in their own chain of command, and for reviewing the results of courts-martial. Victims and advocates say that system discourages victims from reporting and can lead to problems when the accused has a better reputation within the unit than the victim does.

Gen. Mark Welsh told reporters Friday morning that he believes “all options should be on the table” for addressing sexual assault, and that he is “open” to taking some of the UCMJ authority that exists now on sex crimes out of the chain of command. He also said he believes it’s time to strip from commanders the ability to reverse courts-martial findings, though he said he believes commanders should retain the authority to reduce sentences.

The issue came into the spotlight earlier this year, when an Air Force lieutenant general decided to overturn the sexual assault conviction and sentence of a fighter pilot in Italy.

Defence secretary Chuck Hagel on Friday ordered the military to recertify every person involved in programmes designed to prevent and respond to sexual assault, an acknowledgement that assaults have escalated beyond the Pentagon’s control.

He said this step is one among many that will be taken to fix the problem of sexual abuse and sexual harassment within every branch of the military.

At a news conference with General Martin Dempsey, chairman of the joint chiefs of staff, Hagel said he believes alcohol use is “a very big factor” in many sexual assault and sexual harassment cases, but there are many pieces to the problem.

Hagel said it has become clear to him since taking office in February that holding people accountable for their actions is important, but simply firing people is not a solution.

“Who are you going to fire?” he asked.

Sgt. John Russell pleaded guilty as part of a deal with prosecutors

(CNN) —A U.S. Army sergeant was sentenced Thursday to life in prison without parole for gunning down five fellow service members at a combat stress clinic in Iraq.

The sentence handed down at Joint Base Lewis-McChord, near Tacoma, Washington, came after Sgt. John Russell pleaded guilty to the killings in a deal in which prosecutors agreed not to seek the death penalty.

Russell pleaded guilty to the May 11, 2009, killings at Baghdad’s Camp Liberty, telling a military court last month that he “did it out of rage.”

The only question facing the judge, Col. David Conn, was whether Russell committed the slayings with premeditation, which the 48-year-old soldier disputed.

During a brief sentencing hearing, Conn ruled Russell killed with premeditation,” meaning the sergeant could not be given a lesser sentence.

LOS ANGELES (AFP) – A U.S. soldier convicted of killing five of his colleagues in Iraq in May 2009 was sentenced to life behind bars Thursday and dishonorably discharged.

Army Sgt. John Russell was convicted earlier this week over the murders at a clinic for soldiers suffering from war-related stress at Camp Liberty, the largest U.S. base in Iraq.

Russell, who previously denied responsibility, admitted the killings last month in a plea deal to escape a death sentence, worked out by his lawyers at Joint Base Lewis-McChord (JBLM), in the northwestern U.S. state of Washington.

On Thursday he was jailed for life, reduced to the rank of private and given a dishonorable discharge from the military, military spokeswoman Barbara Junius told AFP.

At the time of the Camp Liberty killings, the incident represented the single deadliest toll on U.S. forces in a month in Iraq, and came at a sensitive moment in the US military’s occupation of the country it invaded in 2003.

Russell was on his third tour of duty in Iraq, and his unit was preparing to leave the country.

Due to concerns over Russell’s mental state, his commanding officer had ordered about a week before the shooting that his weapon be confiscated and that he get counseling.

After pleading guilty last month, Russell gave an account of the killings for the first time. The victims were three soldiers receiving care at the clinic and two medical officers.

“I just did it out of rage, sir,” he told the military judge, Col. David Conn, describing how he walked from room to room firing at mental health workers and patients.

“I was upset. I do not remember being angry, but I know that everyone who witnessed me outside the combat stress clinic said I looked angry,” the Los Angeles Times quoted him as saying.

WASHINGTON, May 1 (RIA Novosti) – In the midst of the Cold War on several occasions, nuclear missiles at US Air Force bases were mysteriously shut down, according to US servicemen who said they witnessed the failure of the heavily guarded missile systems.

 

But they don’t blame America’s Cold War enemy, the Soviet Union; they say aliens from space did it.

 

“This was something Russia could have developed, but it turns out they didn’t develop this and we don’t have it either – to be able to shut down nuclear weapons with a beam of light,” David Scott, a former sergeant in the US Air Force, told RIA Novosti at a conference in Washington on encounters with extraterrestrials.

 

Scott and three retired Air Force officers told a panel of six former members of the US Congress at the conference about their experiences with extraterrestrial “visitors” who meddled with US nuclear weapons systems.

 

The five-day conference, called the Citizen Hearing on Disclosure, is sponsored by the UFO truth organization Paradigm Research Group and is being held in the style of Congressional hearings, with time limits for witness testimony, question and answer sessions with former members of Congress, and statements entered into the record.

 

About 40 international researchers, military and scientific witnesses are scheduled to testify during the conference, with some providing what they say is evidence of an alien presence on Earth. The former lawmakers listening to the testimony are each being paid $20,000 to attend the five days of hearings.

PROVIDENCE, R.I.—Relatives of the dead suspect in the Boston Marathon bombing will claim his body now that his wife has agreed to release it, an uncle said as officials in both Washington and Russia deepened their investigations into him and his ties.

The body of Tamerlan Tsarnaev, 26, has been at the medical examiner’s office in Massachusetts since he died after a gunfight with authorities more than a week ago.

Tamerlan and brother Dzhokhar Tsarnaev, both Russian natives who lived for several years in the U.S., are accused of using a weapon of mass destruction during the April 15 marathon. Three people were killed and more than 260 injured when two bombs exploded near the finish line.

Amato DeLuca, the attorney for Tamerlan’s widow, Katherine Russell, said Tuesday that his client had just learned that the medical examiner was ready to release Tsarnaev’s body and that she wants it released to his side of the family.

Police said Tsarnaev ran out of ammunition before 19-year-old Dzhokhar dragged his body under a vehicle while fleeing the scene. His cause of death has been determined but will not be made public until his remains are claimed.

“Of course, family members will take possession of the body,” uncle Ruslan Tsarni of Maryland told The Associated Press on Tuesday night. “We’ll do it. We will do it. A family is a family.”

He would not elaborate. The brothers’ parents are still in Russia, but other relatives on their side of the family in the U.S., including Tsarni.

Dzhokhar Tsarnaev lies in a prison hospital after being wounded in the shootout with police as he and his brother made their getaway attempt. He is charged with using a weapon of mass destruction to kill, a crime that carries a potential death sentence.

In the immediate aftermath of explosions at the Boston Marathon, the New York Police Department stepped up security at landmarks and hotels, said Paul J. Browne, the department’s chief spokesman. The police sent critical response vehicles to prominent locations around the city as a precaution “until more about the explosions in Boston is learned,” Browne said. It is likely that the vast New York City transit system will also see heightened security, at a minimum. Such deployments are routinely taken by the department at times of heightened potential threat. Authorities in Washington also heightened security following initial reports of the explosions, according to a spokeswoman for the Metropolitan Police. Reports say that combat planes flying over Boston to clear airspace.

At 10:00pm eastern, there is still not no motive or no one in custody. Number of injured has risen to 140 with at least 17 of those being in critical condition. Authorities have released a BOLO, or Be On the Look Out, for an individual described as a “darker skinned male, with accent wearing black hood sweatshirt and black backpack.” This person was encountered attempting to gain access to a restricted area. When he was unable to get into the area, he raised suspicions when he “broke eye contact and pulled up his hood.” What should be a joyous celebration of personal achievement turned to tragedy when a pair of bombs, fifty – one hundred yards apart, exploded at the finish line. The explosions, three to four seconds apart beginning at 2:54 pm, have resulted in two deaths, and many more injuries. Reports are that of the injured ten persons required amputations and there are seven multiple-system wounds.

Hospital reports are that they are removing ball bearings from the victims, leading to the belief that the bombs, though reported to be crude, were packed with the bearings and other shrapnel. There is also speculation that the devices were placed down low, such as in the bottom of waste cans, leading to lower extremity shrapnel injuries. An eight-year-old boy and a woman were killed in the blast. Eight other children were also injured. The youngest injured is three and the oldest in her sixties. Six children are reportedly at Boston Children’s Hospital; they are in good to serious, but not critical condition. Representative Wm. Keating (Mass) has said that they have found two other unexploded devices. While the devices are considered crude, they are calling the attack a sophisticated and coordinated event. Frances Fragos Townsend , former Bush Homeland Security advisor says they don’t know yet, if it is domestic or international terrorism. An individual can be responsible for an act of terrorism. Terrorism is a defined act that is not “accidental” such as a gas explosion. President Obama did not say “this is a terrorist attack”.

Boston police and a cadre of federal officials descended on an Ocean Avenue apartment complex in Revere last night. In addition to two Boston Police K-9 units and a bomb squad unit, a large contingent of federal agents from the FBI, Immigration and Customs Enforcement, as well as Homeland Security investigations and state police had assembled at the two buildings. It was unclear whether the search was connected to the Boston Marathon bombings. Tight-lipped agents said nothing to assembled media. Worried building residents said they were left in the dark. Marcus Worthington, 24, a building resident said no one has told him what was happening. “I started noticing the cars, the Taurus there and that one about 5,” Worthington said. “We were thankful we decide not to go down. It’s best not to jump to conclusions.” Worthington’s girlfriend Whitney Drake, 24, was concerned. “It’s never a good thing to see all of these agencies. It’s more than a local problem,” Drake said. Revere Fire Department engine and ladder arrived with Cataldo Ambulance service arrived about 10:30 p.m. Officials had no comment when asked by reporters what was happening. Boston Police Crime Scene Response unit which collects evidence following major crimes arrived and two members of that unit took several brown paper bags, normally used to store evidence taken from the scene, into the building.

Three killed and at least 152 injured in two explosions at the finish line of the Boston Marathon in the United States. Following is an update on investigation status. Only two IEDs detonated. Reports from news media of more undetonated devices was false and likely due to many unattended bags left at the scene. POI (Person Of Interest) who is a Saudi citizen in Revere, MA (suburb of Boston) on student visa was interviewed and his apartment searched last night / early this morning. He was in the hospital for injuries sustained by shrapnel to his lower extremities. He is in protective custody. GRAY reported yesterday that authorities were search was for a dark skinned / black male in sweatshirt / hoodie carrying backpack(s) who is also supposedly a Saudi national or other Arab (perhaps Somali) student. This has turned out to be a solid lead and authorities continue the search for this POI. Authorities were also searching for a yellow Penkse truck. Search continues. Media reports of “ball bearings” used in the construction of the device was false. Devices were placed in trash bins, likely resulting in shrapnel reported by first responders / med techs. The device appears to have been constructed using black powder and its construction has been described as “crude”. Reports of device at JFK Library was unconnected to BM-15APR attack.

The avalanche, at this point, from what he’s describing, is 30 feet wide, eight feet deep and about a quarter-mile long,” she added.

‘I thought I was dying’: 3 hurt, 1 missing in Cascade avalanches

 

SNOQUALMIE PASS, Wash. – Three people were injured and one is missing after a pair of dangerous avalanches barreled down the mountain slopes near Snoqualmie Pass on Saturday amid heavy snowfall, King County sheriff’s officials said.

The first avalanche, on Granite Mountain, injured two snowshoers and left one man missing. The site is off milepost 47 on Interstate 90.

“They started out, everything’s fine, they’re in a gully-type area – when they’re hit by the avalanche,” said Sgt. Katie Larson of the King County Sheriff’s Office.

“One of the climbers tells me that they had no warning. The avalanche, at this point, from what he’s describing, is 30 feet wide, eight feet deep and about a quarter-mile long,” she added.

Larson said one of the hikers was carrying a GPS device, which showed that they were carried more than 1,200 feet down the mountain in the avalanche at speeds of up to 53 mph.

One survivor has a shoulder injury, the other an injured hamstring. Both men are from the Kent-Auburn area.

They were apparently among other snowshoers up in that area who are now helping with the search for the still-missing hiker, a 60-year-old man who is also from the Auburn area.
