Government Spying: Should We Be Shocked?

Last week we saw dramatic new evidence of illegal government surveillance of our telephone calls, and of the National Security Agency’s deep penetration into American companies such as Facebook and Microsoft to spy on us. The media seemed shocked.
Many of us are not so surprised.
Some of us were arguing back in 2001 with the introduction of the so-called PATRIOT Act that it would pave the way for massive US government surveillance—not targeting terrorists but rather aimed against American citizens. We were told we must accept this temporary measure to provide government the tools to catch those responsible for 9/11. That was nearly twelve years and at least four wars ago.
We should know by now that when it comes to government power-grabs, we never go back to the status quo even when the “crisis” has passed. That part of our freedom and civil liberties once lost is never regained. How many times did the PATRIOT Act need renewed? How many times did FISA authority need expanded? Why did we have to pass a law to grant immunity to companies who hand over our personal information to the government?
It was all a build-up of the government’s capacity to monitor us.
The reaction of some in Congress and the Administration to last week’s leak was predictable. Knee-jerk defenders of the police state such as Senator Lindsey Graham declared that he was “glad” the government was collecting Verizon phone records—including his own—because the government needs to know what the enemy is up to. Those who take an oath to defend the Constitution from its enemies both foreign and domestic should worry about such statements.
House Intelligence Committee Chairman Mike Rogers tells us of the tremendous benefits of this Big Brother-like program. He promises us that domestic terrorism plots were thwarted, but he cannot tell us about them because they are classified. I am a bit skeptical, however. In April, the New York Times reported that most of these domestic plots were actually elaborate sting operations developed and pushed by the FBI. According to the Times report, “of the 22 most frightening plans for attacks since 9/11 on American soil, 14 were developed in sting operations.”
Even if Chairman Rogers is right, though, and the program caught someone up to no good, we have to ask ourselves whether even such a result justifies trashing the Constitution. Here is what I said on the floor of the House when the PATRIOT Act was up for renewal back in 2011: “If you want to be perfectly safe from child abuse and wife beating, the government could put a camera in every one of our houses and our bedrooms, and maybe there would be somebody made safer this way, but what would you be giving up? Perfect safety is not the purpose of government. What we want from government is to enforce the law to protect our liberties.”
What most undermines the claims of the Administration and its defenders about this surveillance program is the process itself. First the government listens in on all of our telephone calls without a warrant and then if it finds something it goes to a FISA court and get an illegal approval for what it has already done! This turns the rule of law and due process on its head.
The government does not need to know more about what we are doing. We need to know more about what the government is doing. We need to turn the cameras on the police and on the government, not the other way around. We should be thankful for writers like Glenn Greenwald, who broke last week’s story, for taking risks to let us know what the government is doing. There are calls for the persecution of Greenwald and the other whistle-blowers and reporters. They should be defended, as their work defends our freedom.

“I wish I could say I was shocked at the reports the NSA is secretly spying on the private phone calls of millions of Verizon customers. However, this is a predictable result of a government that continues to erode our liberties while promising some glimmering hope of security.
“The Fourth Amendment is clear; it says we should be secure in our persons, houses, papers and effects, and that all warrants must have probable cause.
“I opposed and continue to oppose the Patriot Act because I believe it throws the Fourth Amendment right out the window. It is certainly not patriotic to support warrantless wiretaps, blanket ‘metadata’ collection, and spying on innocent American citizens.
“Unfortunately, what is worse than the reports, is knowing that politicians of both parties will continue to defend this practice as necessary to supposedly keep us ‘safe’. We do not have to sacrifice our liberties for security. At times like this, the question must be asked, ‘if we are willing to change our way of life and our very definition of freedom while tolerating the invasive searches at our airports and now of our phone calls, have the terrorists already won?’”

More or less every modern politician talks about “freedom” or “liberty.” Actually, they don’t talk about it as much as they use it as a magic incantation. They go on at length about “our free country,” but if you could get them to define freedom, that definition would be something along the lines of “what we have.”
Once we’re past such self-praising nonsense, we’re still left with the original question: What exactly is this “liberty”? And then the trouble begins. There are dozens of definitions. This is a problem. We’re all going around talking about liberty, but no two of us mean precisely the same thing. If you’re looking for reasons why liberty gets so little real traction in the world, this would be a good place to start.
So, it’s about time that we clarified what we mean by these terms. And, since I’ve spent decades pursuing liberty, and since no one else seems to be addressing this, I’ll take on this chore myself.
First of all, I’m going to treat “liberty” and “freedom” as the same concept. After all, the word freedom comes to us from old English and liberty from old French, and they both mean the same thing: unconstrained.
The problem with unconstrained lies in the fact that we are constrained by the natural world, by everything from gravity to rocks to weather. Nature constrains us. Yet, we don’t feel oppressed by nature – it isn’t trying to hurt us or limit us, it simply is what it is, and we can use it as we wish too. Our bodies are part of nature, after all.
It is when other people force us to obey, use violence against us, our simply intimidate us, that we feel constrained and abused. (Which tells us all we really need to know about the nature of liberty and humanity.)
So, here is a precise definition for freedom/liberty:
A condition in which a man’s will regarding his own person and property is unopposed by any other will.
That is the bedrock. From there you can add other aspects if you wish, but you cannot deviate from this core and still be talking about “liberty.”
For example, Thomas Jefferson used the same core idea (notice the inclusion of “will”), but added a political aspect:
Rightful liberty is unobstructed action according to our will within limits drawn around us by the equal rights of others. I do not add “within the limits of the law” because law is often but the tyrant’s will, and always so when it violates the rights of the individual.
The great John Locke also held to this core, but took it in a more philosophical direction:
All men are naturally in a state of perfect freedom to order their actions, and dispose of their possessions and persons as they think fit, within the bounds of the law of Nature, without asking leave or depending upon the will of any other man.
Personally, I like a very plain version of the same sentiments:
We should be allowed to do whatever we want, so long as we don’t hurt others.
I generally call these statements as Lockean, since John Locke was the first person to clearly define the concept of liberty in modern times. But, that’s just my preference.
These statements are clear, and they define liberty. No more really need be said.
You can ignore manipulative “freedom to” statements like Franklin Roosevelt’s famous Second Bill of Rights, whose proposed ‘rights’ included the right of everyone to their own home. This, of course, would require the enslavement of builders, suppliers and taxpayers. (Roosevelt never mentioned that side of the equation, of course.)
There’s only one thing which I will add to this discussion, and that is this: None us have a monopoly on Lockean liberty.
Anyone who holds to Locke’s formulation is your brother and sister, and you must accept them as such.
We are past the time when we can be insular (if there ever really was such a time). You don’t have to agree 100% with the Ron Paul people or the free-market anarchists, or with anyone, but if they accept the core statements above, you must accept them as joint heirs of the Lockean liberties.
If you think someone is wrong, you can ignore the difference of opinion, or you can, respectfully, correct them. Better still, you could laugh at your joint human frailties and move forward together. What you may not do, is to cast them off as idiots; you may not resent them for honestly disagreeing. If they believe in John Locke’s liberty, they are your allies, not your enemies.
If we can’t do that, we don’t deserve to succeed.

SHOCKING FOOTAGE: Americans Ordered Out Of Homes At GUNPOINT By SWAT teams in BOSTON

Shocking footage has emerged from Friday’s lockdown in Boston, where police, federal agents, national guard troops and SWAT teams enforced door to door searches of everyone’s home within twenty blocks as the entire city was placed under orders to stay off the streets.
The video, shot by a resident from their own house across the street, shows police barking orders at men and women as they order them at gunpoint to identify themselves, put their hands on their heads, and get out of their own home. They are then ordered to run down the street to be further frisked by police as scores of armed militarized cops look on.
The scenes look like something out of a disaster movie, with the backdrop of suburban America juxtaposed with what is essentially martial law playing out in full daylight.
The story floated in the mainstream media that the door to door searches were conducted with the voluntary consent of the residents of Watertown is clearly false. 9000+ Police locked down an entire city and went in with full force, with armored vehicles and combat gear, all to search for an injured 19 year old kid who turned out to be cowering in someone’s back yard.
While armies of police roamed around people’s homes and private property, Public transportation was shut down, businesses were forced to close, and a no-fly zone was enacted over Boston in an unprecedented show of force. boston bombing
At this point, as military helicopters buzzed over neighborhoods, the Fourth Amendment had ceased to exist in Boston, which quickly resembled a war zone.
The compliant mainstream media reported on the activity without alarm or question. Katy Waldman of Slate wrote an article claiming that under dire circumstances police can suspend 4th Amendment rights against unreasonable searches:

This exception to the Fourth Amendment’s probable cause requirement normally addresses situations of “hot pursuit,” in which an escaping suspect is tracked to a private home. But it might also apply to the events unfolding in Boston if further harm or injury might be supposed to occur in the time it takes to secure a warrant.
This activity, once again, sets a shocking precedent. Police and military are training in these circumstances every single day of the year. They are fully acclimatized to the process, as if it is completely normal. They do not hesitate in carrying out such orders, which are now being implemented whenever the authorities deem a situation to be an emergency.

A growing number of senators are trying to quash gun legislation before it even hits the chamber floor as Democrats hold out hope for a compromise and the White House gears up for a weeklong offensive to pressure Congress to act.
Larry Pratt, executive director of Gun Owners of America, said as many as 13 senators now publicly support a filibuster on the motion to proceed on pending gun legislation, which effectively would block debate on the bill.
“When you’re in a snake pit, you kill a snake any time and chance that you get,” Mr. Pratt said on C-SPAN’s “Newsmakers” that aired Sunday. “When you’re dealing with legislation, you take your best shot as soon as you can.”
Republican Sens. Rand Paul of Kentucky, Mike Lee of Utah and Ted Cruz of Texas wrote a letter to Senate Majority Leader Harry Reid last week saying they intend to delay Mr. Reid’s efforts to move a legislative package that currently includes measures to require background checks on all gun sales. Politico also reported that another letter with Monday’s date now has 13 signatures on it.
Sen. John McCain, Arizona Republican, said Sunday that whether he can support requiring background checks at gun shows depends on precisely how they’re carried out — but that there should be a debate on the issue.
Sen. Lindsey Graham, South Carolina Republican, also has said he would not support a filibuster.
Federally licensed firearms dealers are required to conduct background checks on gun purchasers, but the so-called “gun show loophole” exempts private sellers from the requirement.
Mr. Reid, Nevada Democrat, would need 60 votes to shut down a filibuster.

(NaturalNews) Colorado and Washington pot smokers are lighting up in celebration after having achieved a stunning decriminalization victory at the ballot box. Inhale while you can, my brothers and sisters, because Obama is already plotting how to re-criminalize your swag and nullify states’ rights.
Marijuana decriminalization, you see, was a states’ rights victory that more or less flipped Washington D.C. the finger. From Obama’s point of view, this simply cannot be allowed to stand because it would set a precedent of the tyrannical federal government “allowing” states to decide their own laws, separate from federal law. While the U.S. Constitution clearly encourages precisely such a structure, the U.S. federal government that exists today operates like a power-hungry gang of thugs who seek to crush anyone and anything that threatens to stand against it. There does not even exist the facade of respecting the limitations of federal government described in the Constitution.
Mark my words: Obama, who is himself an admitted pot smoker, is coming after YOUR right to smoke pot.
It will start with polite-sounding lawsuits. The federal government will claim total control of all individual activity under the “commerce clause” of the U.S. Constitution and pressure a few key federal judges to overturn state decriminalization laws.
If, for some reason, that fails, the DEA — which operates much like a pack of hungry wolves barely restrained on a short leash — will be given the green light to start conduct armed federal raids in Washington and Colorado. The point of the raids? To send the message that the feds are still in charge, regardless of what the voters say.
All the pot smoking voters in Washington and Colorado are about to receive a valuable lesson in power. They think they have won a permanent victory for liberty, even if they don’t describe it in those words. In reality, all they have done is antagonize federal forces of evil which are already planning a powerful counter-assault that will remind the slaves of America (the voters) who is really in charge.
And why? Because if marijuana decriminalization is not crushed by the political forces in Washington D.C., then its very existence might encourage other states to decriminalize things like industrial hemp farming, holistic medicine or even raw milk. For God’s sake, states might behave under the misimpression that they control their own destiny!
On this subject, I’ve already published a list of five things any state could legalize right now in order to experience an economic golden age. Each of these fives things would require states to assert their Tenth Amendment rights to nullify the power of the federal government within the state’s own borders. This is precisely what Colorado and Washington have done with marijuana decriminalization laws. They may not call it a “Tenth Amendment” initiative, but that’s exactly what it is.
Make no mistake that the federal government will use any means necessary to reverse this: Lawsuits, armed raids, false flag attacks, propaganda campaigns and so on. The federal government in America today is run by truly maniacal power-hungry criminals. Ron Paul calls Washington bureaucrats “psychopathic tyrants.” There is absolutely nothing they won’t do to enforce their fabricated authority over the states and the People.
If it means marching into Colorado with federal troops and shoving rifles in the faces of small-time pot growers, that’s exactly what they will do. For those of you in Colorado and Washington right now, do not suffer under the delusion that you are now free to smoke pot with impunity. You have merely achieved a reversible ballot victory that was only allowed to take place because the vote fraudsters were too busy stealing other elections (Prop 37!) to effectively defeat your marijuana decriminalization ballot measures.
It is good that you did achieve that victory, of course, because now the real lessons in liberty will be realized. At this point, Obama has no choice but to show his vindictive double standard where it’s okay for the President to campaign on the “coolness” of having smoked pot and inhaled, but his own voters who do the same thing will be arrested at gunpoint and incarcerated in federal prisons. And if you’re black like Obama, by the way, your prison sentence will be double or triple that of white offenders.
That’s real tyranny, and that’s the real Obama. Those of you voted for Obama and are enjoying your temporarily-legalized pot in Colorado or Washington are about to learn a very costly lesson in federal tyranny. Within a year, your states will be under assault by the feds, and your freedoms will be even further stripped away by the very President who campaigned on the idea that the government would listen and respond to the needs of the voters.
Obama lied. The federal government doesn’t want liberty in America; it wants CONTROL.
DEA agents are right now salivating at the thought of identifying, targeting and raiding small-time pot gardens in Colorado. Those who flaunt their growing, harvesting or smoking will be the first who are targeted. Don’t say you weren’t warned.

The Texas petition now has over 100,000 signatures, and more signatures are appearing by the hour.
It raises the practical question: Could Texas survive as a nation state if it secedes from the union?
The short answer is YES.
As you’ll see here, Texas is unquestionably the state best positioned to function as its own nation. Here’s why:
• Texas is a fiercely independent culture. It has already been its own nation, the Republic of Texas, from 1836 to 1846.
• Texas is the only state with its own independent power grid.
• Texas can grow more than enough food to feed itself (and trade with neighboring states).
• Texas is the energy empire of America, with massive resources of natural gas, petroleum, solar and wind. It contains the largest untapped oil reserves in North America, save for Alaska.
• Texas has physical possession of America’s oil refineries. (Key strategic resource!)
• Texas has abundant technology and telecommunications. It is the “silicon valley” of the South.
• Texas has the basic infrastructure of a space program. The Apollo program, after all, was based out of Houston.
• Texas has a ready labor force.
• Texas has abundant natural resources, including water, soil, sunlight and seeds. There are 15 major rivers that run through Texas.
• Texas has manufacturing know-how and a “can-do” culture of practical people who know how to solve problems.
• Texas has multiple shipping ports and international airports, allowing high-volume international trade with other nations.
• Texas has the capability of defending itself against threat of invasion or military force. Tens of millions of firearms are already owned by well-skilled farmers, ranchers and military veterans. Any attempt to occupy Texas with a military force would be far worse than trying to occupy Afghanistan.
• Texas has a world-class university education system.
• Texas has a history of independence from tyranny. It’s part of the Texas DNA.
• Texas has diverse ecology, with 10 climatic regions, 14 soil regions, and 11 distinct ecological regions.
• Texas is a state with tremendous citizen pride. More than in any other state, Texans identify their state as a source of strength and independence.
• Texas citizens have a sense of ethics and morality that’s simply missing from many other areas (most notably the Northeastern USA). In Texas, people generally know the difference between right and wrong, and they typically seek to do the “right” thing.
• Texas has Ron Paul! (Need we say more?)
• For starters, Texas could abandon the failing U.S. currency and create its own honest money system. This effort should, of course, be led by none other than Ron Paul, the man who should also be considered for the role of President of Texas.
• The abandonment of the U.S. currency also means Texas could walk away from the U.S. federal debt. This frees Texas from an almost insufferable financial burden, allowing it to start over with a clean slate and an honest currency. The Central Bank of Texas would be owned by the People of Texas, not by a private corporation (such as with the Federal Reserve).
• Across the state of Texas, all federal wage taxes would be eliminated, meaning that employee take-home pay would rise and the cost of hiring employees would sharply drop. This would cause a surge of business investment across the state of Texas as employers flock to the state to lower their costs of conducting business in North America.
• This, in turn, would cause a massive jobs boom as everybody in the state of Texas with any decent education would be able to find a job offering good pay.
• The lack of any further burden to fund the U.S. empire’s military presence in over 130 nations around the world would equal a financial windfall for Texas, which could use the new surge in business taxes and sales taxes to fund real infrastructure: Expanded universities, railroads, airports and more.
• Across the new nation of Texas, there would no longer be any need to file a federal income tax return on April 15th. This alone would vastly improve the “happiness quotient” of all Texans.
• If Texas simultaneously legalized health freedom as was suggested by Rep. Ron Paul in his “Health Freedom Protection Act,” the state would experience yet another economic boom in the realm of natural medicine practitioners and natural product manufacturers. To accomplish this level of freedom, however, the criminally-run Texas Medical Board would need to be gutted and replaced with people who understand and appreciate the role of complementary medicine in preventing chronic disease (nutrition, medicinal herbs, etc.).
• If Texas ended the absurd federal criminalization of growing industrial hemp, the state could experience a golden revolution in farming through the state-wide planting and harvesting of hemp. This would transform Texas into an agricultural Mecca and instantly make it a massive exporter of high-profit hemp to the other 49 states.
• As its own nation, Texas would shut down all federal offices within the new nation of Texas, expelling feds as people with no authority. This would immediately end the scourge of the DEA, ATF, FDA and USDA, among other “gang-style” agencies that routinely betray the American people. Instead, Texas would form its own local agencies to handle any necessary tasks, all with the benefit of local input and local planning.
• Any who did not wish to be part of Texas as a new independent nation would be free to leave the state and continue their lives in the collapsing economy of Obammunism, with all its police state tyranny, oppression and destruction of the Bill of Rights. This would include the entire City Council of Austin, a cabal of corrupt communists and Big Government apologists who would likely be marched to the border of Texas at gunpoint. As Obama’s nation collapses under debt and tyranny, Texas will be growing by leaps and bounds under a renewed philosophy of economic freedom for the People.

Russell Means, a self described “Oglala Lakota Patriot and Freedom Fighter”, began his journey to the spirit world at 4:44 am, with the Morning Star, at his home and ranch in Porcupine yesterday.
Per his wishes, Means will be cremated and his ashes will be spread over the Black Hills, which are considered sacred by the Lakota.
This Honoring will be the first of four opportunities for the people to honor his life. The next three Honorings have been tentatively scheduled as follows:
2nd Honoring at Wounded Knee ’73 Occupation Memorial (Feb 2013);
3rd Honoring at Wind Cave State Park, South Dakota (June 2013);
4th Honoring on Russell’s birthday (Nov 10, 2013) at location to be determined.

American icon and patriot Russell Means passed away on October 22, several weeks after a delegation of Lakota leaders told the State Department they were unilaterally withdrawing from treaties they signed with the federal government of the United States. Lakota country includes parts of the states of Nebraska, South Dakota, North Dakota, Montana and Wyoming.
Means, 72, died earlier today at his ranch in Porcupine, South Dakota, Oglala Sioux Tribe spokeswoman Donna Solomon said. In August 2011, Means announced he had inoperable throat cancer. He eschewed big pharma and medical establishment treatments in favor of traditional American Indian remedies and alternative treatments.
He joined the American Indian Movement in 1968 and staged a number of protests, including occupying the Mayflower II, a replica ship of the Mayflower, and staged a takeover of Mount Rushmore, a federal monument.
In 1973, Means and other AIM activists engaged the FBI in a standoff at Wounded Knee. More than 300 AIM members resisted the government for 71 days.
Unlike other AIM activists, Means held a libertarian political philosophy. He ran for the nomination of President under the banner of the Libertarian Party and came in second in the 1987 Libertarian National Convention, but lost the nomination to Ron Paul. In January 2012, Means backed Ron Paul’s presidential campaign.
In 2007, Means and other American Indian activists backed the non-binding United Nations Declaration on the Rights of Indigenous Peoples and sent a letter to the State Department indicating they would withdraw from all treaties with the United States, some of them more than 150 years old.
Also in 2007, Means and a delegation of activists declared the Republic of Lakota a sovereign nation, with property rights over thousands of square miles in South Dakota, North Dakota, Nebraska, Wyoming and Montana.

American Indian Russell Means gives an eye-opening 90 minute interview in which he explains how Native Americans and Americans in general are all imprisoned within one huge reservation. “The history of the American and the history of the Indian have now come full circle and are intertwined in the dictatorial policies of those that control the monetary system of America,” remarks Means.
