City leaders in Oxford, Ala. have approved the destruction of a 1,500-year-old Native American ceremonial mound and are using the dirt as fill for a new Sam’s Club, a retail warehouse store operated by Wal-Mart.{C}A University of Alabama archaeology report commissioned by the city found that the site was historically significant as the largest of several ancient stone and earthen mounds throughout the Choccolocco Valley. But Oxford Mayor Leon Smith — whose campaign has financial connections to firms involved in the $2.6 million no-bid project — insists the mound is not man-made and was used only to “send smoke signals.”

“The City of Oxford and its archaeological advisers have completed a review and evaluation of a stone mound that was identified near Boiling Springs, Calhoun County, Alabama, and have concluded that the mound is the result of natural phenomena and does not meet the eligibility criteria for the Natural [sic] Register of Historic Places,” according to a news release Smith issued last week.

In fact, the report does not conclude the mound is a result of “natural phenomena” but says very clearly it is of “cultural origin.” And while the University’s Office of Archaeological Research does not believe the site qualifies for the National Register of Historic Places, the Alabama Historical Commission disagrees, noting that the structure meets at least three criteria for inclusion: its “association with a broad pattern of history,” architecture “embodying distinctive characteristics,” and for the information it might yield to scholars.

The site is also significant to Native Americans. The Woodland and Mississippian cultures that inhabited the Southeast and Midwest before Europeans arrived constructed and used these mounds for various rituals, which may have included funerals. There are concerns that human remains may be present at the site, though none have been found yet.

United South and Eastern Tribes, a nonprofit coalition of 25 federally recognized tribes from Maine to Texas, passed a resolution in 2007 calling for the preservation of such structures, which it calls “prayer in stone.” Native Americans have held protests against the mound’s demolition, and last week someone altered a sign for the Leon Smith Parkway that runs past the development to read “Indian Mound Pkwy.”

It’s  amazing  how little the liberal  rhetoric  has  changed.  Whenever there is  an  issue  with  policy  or Federal encroachment on State  sovereignty .  They drag  out the  worn out race  card and  insults.

The  amusing  point to all this  is that they  believe  themselves  so  intelligent  and  have  such  lofty  impressions of  themselves  that  they  do not take the  time  to look at   the  people  they are insulting.  WE  are  made  up of minorities,  disillusioned   Democrats,  fed  up environmentalists, disgusted working class  Americans.  And  yet  we  are  all ignorant  rednecks  with a  racists  agenda.  LOL!!

The lines  are getting old  and the only thing  they  have  accomplished is to expose  their ignorance  of  the   Law of  The  Land.  Perhaps,  they  need a memorable  lesson to assist  in the assimilation  of  the necessary  information  to  permeate those  thick  skulls.  Not  to mention  a  bit  of  air  let  out of  those  over bloated  egos would be in  order……

A Basic Civics Lesson for Pseudo-Historians

This according to the keepers of acceptable opinion at two divergent publications.

Both The Economist and the Montgomery Advertiser recently ran opinion pieces skewering nullification, specifically state efforts to block unconstitutional federal gun laws in Kansas and Alabama. Interestingly, both the author of  The Economist piece and the editorial board over at the Alabama newspaper used the same strategy. They both try to make their readers believe anybody who actually views nullification as legitimate must not be too bright. Their implication? “The federal government enjoys absolute supremacy and  a bunch of dumb racist, rednecks who don’t know anything about the U.S. government want states to ignore laws they don’t happen to like.”

From the Economist: “It is remarkable that a civics lesson like this is necessary.”

The Montgomery Advertiser editorial board gets even snarkier.

“That body (the Alabama Senate) has taken a plunge into the past by revisiting and embracing the long-discredited practice of nullification, the notion — abandoned decades ago by most people who passed sixth-grade civics.”

Talk about groupthink. Federal supremacists apparently find the whole “civics lesson” theme clever. I have to admit – it does effectively create the impression that nullification supporters wander around in ignorance among the illiterate and uneducated. But the mockery would prove even more effective if the writers actually knew what in the hell they were writing about.

Here’s the problem: these amateur historians actually think the three things they leaned in their government school sixth-grade civics class make them some kind of experts. They might want to move on from pre-civics to basic civics before they try demeaning those of us who actually know the historical and the philosophical basis for nullification.

Let’s touch on a few basics, shall we?

1. Federal Supremacy – These wanna-be historians actually think the federal government stands absolutely supreme all the time, no matter what. They apparently never bothered to  put down the sixth-grade textbook and read the actual supremacy clause in the Constitution. If they did, they would find that only acts “in pursuance of” the Constitution stand supreme. Yes Virginia, federal supremacy actually has limits! Alexander Hamilton made this clear in Federalist 33.

“If a number of political societies enter into a larger political society, the laws which the latter may enact, pursuant to the powers intrusted [sic] to it by its constitution, must necessarily be supreme over those societies and the individuals of whom they are composed….But it will not follow from this doctrine that acts of the large society which are  not pursuant to its constitutional powers, but which are invasions of the residuary authorities of the smaller societies, will become the supreme law of the land. These will be merely acts of usurpation, and will deserve to be treated as such. Hence we perceive that the clause which declares the supremacy of the laws of the Union, like the one we have just before considered, only declares a truth, which flows immediately and necessarily from the institution of a federal government. It will not, I presume, have escaped observation, that it expressly confines this supremacy to laws made  pursuant to the Constitution.”

2. The extent of federal power – While we’re on the subject of limits, our civics professors apparently need a reminder. The federal government can’t just do whatever it wants. It operates under strict limits. The feds can only exercise powers delegated to it in the Constitution.  James Madison described the extent of federal power in Federalist 45. He insisted that the powers delegated to the general government were “few and defined,” and those left to the states and people were “numerous and indefinite.” The ratifiers even insisted on a Bill of Rights “in order to prevent misconstruction or abuse of its powers.”

3. Who decides constitutionality? - Federal supremacists sell you a load of crap. They want you to believe the people of the states created a federal government with limited, enumerated powers, insisted on further “declaratory and restrictive clauses” – the Bill of Rights -   and then left it to that government to decide the extent of its own power. This idea not only earns them an F on their civics test, they also fail their logic test. Basically, these geniuses want the Dallas Cowboy player to referee the Dallas – New York Giants football game. How do you think that would turn out for the Giants?

Fact: the  people of the states created the federal government in the first place. Therefore, the people of the states retain the right, in the last resort, to determine the extent of the powers they gave to the government they created. So yes, Kansas can determine what limits the Second Amendment places on federal regulation of firearms. Granted, this idea may fall into the realm of advanced civics, so maybe we should let a real expert explain it. How about we call on Madison, the “Father of the Constitution?”

“The States then being the parties to the constitutional compact, and in their sovereign capacity, it follows of necessity, that there can be no tribunal above their authority, to decide in the last resort, whether the compact made by them be violated; and consequently that as the parties to it, they must themselves decide in the last resort, such questions as may be of sufficient magnitude to require their interposition.”

Passengers who spent days stuck on a cruise ship in the Gulf of Mexico have described deplorable conditions onboard the powerless vessel. After five days at sea, they are now safely back on land in Alabama. The ship, Carnival Triumph, is being taken for repairs. Al Jazeera’s Charlotte Whale reports.

A 5-year-old boy was found safe on Monday after law enforcement agents stormed an underground bunker in southern Alabama. The boy’s kidnapper was killed. NBC’s Gabe Gutierrez reports.

Following a daring rescue, a 5-year-old boy held captive for seven days in an underground bunker in southern Alabama is alive and his kidnapper, Jimmy Lee Dykes, is dead, the FBI said Monday afternoon.

“Within the past 24 hours negotiations deteriorated and Mr. Dykes was observed holding a gun,” Special Agent in Charge Stephen Richardson, of the Mobile, Ala., office, said at a press briefing Monday. “At this point, FBI agents, fearing the child was in imminent danger, entered the bunker and rescued the child.”

The child was recovered at 3:12 p.m. CT and appears physically unharmed, Richardson said. He is being treated at a local hospital.

The Dothan Eagle newspaper reported that two loud blasts came from the scene shortly before 3:30 p.m. According to the report, an ambulance then drove up the private dirt road where Dykes’ homes is located and then left a short time later.

The blast apparently came from a “diversionary device,” an FBI source confirmed to NBC News. FBI officers then went through a door at the top of the bunker.

Dykes — described by his neighbors as a paranoid survivalist — grabbed the boy from a school bus in Midland City, Ala., just after 3:30 p.m. CT last Tuesday.

On Tuesday, Dykes boarded the bus and demanded that the bus driver, Charles Poland, 66, turn over two young children. When Poland refused, Dykes then fatally shot him and took the boy identified by only his first name, Ethan.

Dykes, a decorated Vietnam veteran, then took Ethan to an underground bunker that neighbors had seen him digging. The bunker is believed to be roughly 8 feet by 6 feet and to be stocked with supplies. The bunker has a ventilation pipe that authorities used to deliver items. Authorities have not said how long they believe Dykes could have lasted underground, or discussed a motive for the kidnapping.

Multiple local and county officials were on the scene of the shootng Tuesday, Jan. 29, near Midland City, Ala.

Updated at 12:10 a.m. ET: A man boarded a school bus in southeastern Alabama on Tuesday afternoon, fatally shot the driver and then grabbed a 6-year-old before fleeing, authorities said, according to The Associated Press.

Authorities said the man took the child to an underground bunker behind a nearby church, according to the AP. Police were negotiating with the suspect late Tuesday evening. WSFA 12 News reported that the child is still with the suspect and is “OK.”

The Dale County Sheriff told WBMA-TV that the man demanded a child be let off the bus with him. When the driver refused, police said, the man shot the driver. The driver died of gunshot wounds.

Michael Creel, a neighbor of the suspected shooter, told The Dothan Eagle newspaper that his sister heard gunshots so he went outside. He saw children running away from the bus.

As people in Beijing and northern China struggle with severe air pollution this winter, the toxic air is also making life hard for plants and even food crops of China, say researchers who have been looking at how China’s plants are affected by air pollution.

Beijing’s extreme smog event this week has made headlines, with the American Embassy calling the pollution levels “hazardous” and Beijing writer Zheng Yuanjie blogging that “the air smells like sulfur perfume, as the capital city currently looks like a poisonous huge gas can,” according to a report on Al Jazeera.

“In the last 50 years there has been a 16-fold increase in ozone pollution” in the Beijing area, said Hanqin Tian of Auburn University in Alabama, who studies the effects of China’s pollution and climate change on plants. He said the soup of pollutants, including harmful sulfur and nitrogen compounds “is definitely expanding into new areas; into the countryside.”

Hickory Ground in Wetumpka, AlabamaHickory Ground in Wetumpka, Alabama

The suit claims the Poarch Band of Creek Indians knowingly excavated approximately 57 sets of human remains and relocated the remains in April 2012 to develop a $246 million casino on Hickory Ground.

Hickory Ground is listed on the National Register of Historical Places because it was the last capital of the Creek Nation before forced removal to Indian Territory, in what is now Oklahoma, and because previously undisturbed Muscogee burials are located there.

The lawsuit is filed against the Poarch Band of Creek Indians and its officials, construction contractors Flintco, LLC and Martin Construction Inc., Auburn University and the US Department of the Interior.

The federal lawsuit was filed in the US District Court for the Middle District of Alabama. It claims:

Description
The National Weather Service has confirmed that storm damage in Birmingham, Ala., was caused by a tornado with maximum winds estimated at 90 mph. Forecasters say the tornado hit at about 4:45 a.m. Monday near the Birmingham farmer’s market. Mayor William Bell says there are no reports of injuries. However, the storm damaged roofs and broke windows. He says the city provided tarps to residents whose roofs were damaged. Homeowner Clint Thornton said that he was about to leave for work when he saw a funnel cloud. Thornton says he took cover in a closet with his wife and started praying. The Thorntons are fine, but nearly all the windows in their home are broken.

Alright, there have  been  quite a  bit of  reports   on the  States  filing  for  secession.  The  last  known  reports  have  read   47  States last  count.  I wanted  to make  sure the  numbers  were  right  so  I  have  gone to the  Whitehouse.gov  site  to see the petitions for myself  and   this is  what  I  found    petitions.whitehouse.gov
