Colorado: Thousands at HIV risk from dentist’s reused syringes, needles

DENVER — A suspended Colorado dentist reused syringes and needles in his now-shuttered practice, potentially exposing thousands of patients to HIV and hepatitis infection, health officials warned on Friday.

The Colorado Department of Public Health and Environment sent letters to 8,000 patients of dentist Stephen Stein, urging them to seek tests for the diseases after learning of “unsafe injection practices” at two Denver-area clinics he owned between September 1999 and June 2011.

Investigators found that Stein reused needles and syringes in several patients’ intravenous lines at his oral surgery and dental implant clinics, in violation of standard medical protocol, the department said in a statement.

“This practice has been shown to transmit infections,” the statement said. It added that there had been no confirmed cases of anyone contracting the viral infections through Stein’s clinics.

The Denver Post reported that the syringes cost less than $1, according to dentists.

In the letters sent to Stein’s former patients, the health department urged them to be tested for HIV, hepatitis B and hepatitis C, said Jan Stapleman, a department spokeswoman.

Stein’s records were incomplete, so it is likely more people were possibly exposed than those already identified, she said.

A hot line established for Stein’s patients to call was “very busy” all day on Friday, Stapleman said.

Stein’s lawyer, Victoria Lovato, said her client “is cooperating with the state’s investigation.”

‘How do I know I’m safe?’
“I don’t know how clean their instruments were at the time,” Lillian Carillo, who was a patient of Stein’s in May 2008, said according to local NBC News station KUSA. She had a tooth extracted on that day.

“I don’t know what to do. I did get an injection. He did use tools on me for the extraction. How do I know I’m safe?”

She said that she was surprised about the accusations.

“When I went to this office, I remember it being over the top. I remember the equipment [was] top of the line,” Carillo said.

Jeannette Monical, who sent her two daughters to Stein to get their wisdom teeth removed, said she was “going crazy inside,” KUSA reported.

“I want him to pay the price. I want him to [go to] prison,” she said.

Authorities said any patient who underwent any type of injection at the clinics, including sedation, might be at risk. They cautioned that if any patients of Stein tested positive for any of the viruses, there was no way to determine how they contracted the disease.

Stein’s license to practice dentistry in Colorado was suspended for an unrelated matter, said Cory Everett-Lozano, spokeswoman for the state Department of Regulatory Agencies, which oversees medical licenses.

Until that probe is resolved, the reasons for Stein’s current suspension are confidential, she said.

Lynn Kimbrough, a spokeswoman for the U.S. Attorney’s Office in Denver, said Stein was already the target of a criminal probe for possible prescription fraud before the allegations emerged about reusing syringes. She said no criminal charges had so far been filed.

Fat-melting device a weighty matter for FDA

For several years, doctors and medical spas around the country have touted a fat-melting device called the LipoTron 3000, or Lipo-Ex, as a revolutionary way for people to slim down.

Signature Medical Spa in Tampa, Fla., in an online pitch for its “Lipo-Ex Spring Fling Fat-Off!,” described the technology as “truly the only non-invasive way to reduce fat.”

Praise also came from Sculpt Medical Spa in Chicago, which called the procedure  “the most innovative, effective, and technologically advanced” non-surgical method of removing fat.

Doctors have appeared on TV news shows in Houston, Phoenix and Miami to promote LipoTron treatments.

These testimonials have translated into millions of dollars in sales for physicians,  med spas, and the device’s manufacturer, RevecoMED International of Fullerton, Calif.

But there’s a problem: The LipoTron, which targets fat with radiofrequency waves, has never been cleared or approved by the U.S. Food and Drug Administration, which would make it illegal under federal law to sell or promote it for weight loss.

The FDA is aware of the activity. But an investigation by FairWarning found that the agency has not taken enforcement action — even though it has known about the situation at least since January, 2010. At that time, two whistleblowers, one a former LipoTron distributor, provided sales records and a trove of other documents to an FDA criminal investigator.

The case spotlights the booming, multi-billion-dollar business of aesthetic medicine—and the willingness of some doctors and med spas to use unapproved devices as they vie to be first with the latest technologies to smooth wrinkles, tighten skin and sculpt the body.

The FDA won’t say if it is investigating Reveco, citing a policy not to discuss investigations or acknowledge if there is one.

For his part, RevecoMED President James S. Rosen said the agency hasn’t contacted the company. He asserted that, “As of today, we are compliant with the FDA.”

Still, for observers such as Dr. Patricia K. Farris, a clinical associate professor of medicine at Tulane University and a spokesperson for the American Academy of Dermatology, the situation is baffling.

Told of the unauthorized sales, Farris responded: “It shocks me the FDA would not have cracked down on them.”

“I mean, radiofrequency is an electrical device, and you can’t just be throwing these things in the marketplace without doing the right studies to make sure that, A, the device is safe and, B, that the thing does something and has some benefit.”

Dr. Suzanne Yee, a Little Rock, Ark., plastic surgeon whom Reveco asked several years ago to take part in a LipoTron study, said she was surprised to learn that the company already was selling the device.

She noted that some medical spas have falsely stated on their websites that the LipoTron is FDA-approved. “It’s not FDA-approved,” Yee said. “I think that’s dishonest.”

There have been scattered incidents of patients receiving minor shocks and burns from LipoTron treatments, but no known reports of serious injury.

While the FDA has failed to act, the Texas Department of State Health Services issued a warning letter last September to a Fort Worth distributor for marketing the LipoTron without FDA clearance. According to an agency report, Mark Durante, managing partner of Advanced Aesthetic Concepts, told state investigators that the LipoTron had been cleared by the FDA, but later corrected himself to say paperwork had been filed but no clearance yet given.

Durante told FairWarning that, in response to the warning, his company changed some language on its website. However, a spokeswoman for the Texas agency said it recently opened a second complaint investigation of Advanced Aesthetic Concepts.

Selling for as much as $85,000, the LipoTron passes radiofrequency waves through the body to heat, and destroy, fat cells. According to Reveco, the procedure targets subcutaneous fat, which is just below the skin, as well as visceral fat surrounding the vital organs, but without harming adjacent tissues. Spas typically recommend six to eight treatments for about $400 each.

According to interviews and records, Reveco first sought a green light from the FDA in 2007. It chose the FDA’s market clearance procedure, which is less demanding than the formal approval process.

To get a new device cleared this way, the manufacturer must show it is similar in safety and effectiveness to products that are already on the market.

However, Reveco’s bid failed. The company’s initial application “wasn’t in-depth enough,” Rosen said, and the FDA repeatedly sought additional data. Finally, according to Rosen, “We said, ‘You know what, it’s not worth it.”

According to interviews and a document reviewed by FairWarning, the FDA then told Reveco that the device could not be marketed.

LipoTron sales continued, however. Rosen wouldn’t disclose how many of the devices have been sold, but the number is believed to be in the low hundreds.

In 2011, Reveco took another tack with the FDA. It classified the LipoTron as a massager used for relief of minor pain. That would make it, in FDA parlance, a Class 1 device — a category that includes such simple, low-risk items as elastic bandages and examination gloves.

The advantage for Reveco is that massagers can be sold without a green light from the FDA. They automatically are exempt from FDA review and can be put on the market once a notice is filed.

Yet doctors and med spas have been promoting the device on the Internet not for massages but for removing fat.

Rosen said that was not Reveco’s responsibility, stating that the company can’t dictate what doctors do or “police everything out on the Internet.”

Asked who would pay $85,000 for a massager, Rosen replied: “Anybody that wants to buy it.”

Physicians are free under federal law to prescribe unapproved, or “off-label,” uses of drugs or medical devices — but only if the products have been cleared or approved for another purpose, according to the FDA.

FDA spokeswoman Sarah Clark-Lynn said in an email that if a device is not legally on the market, “a physician should not have been able to obtain it, much less use it on a patient.”

Dr. Sherwood Baxt, a New Jersey plastic surgeon who advertised the procedure in a promotional video, said that when he bought the LipoTron he wasn’t troubled by its lack of FDA clearance. He explained that he had used unapproved devices before and, while he considered the agency’s green light a marketing advantage, he didn’t consider it necessary.

Besides, Baxt said, “We were told FDA approval was imminent.”  It didn’t work out that way, however, and, he said, “After two years, I just stopped asking.”

He continues to use the device for skin tightening on certain patients but quit using it for fat reduction. For fat reduction, Baxt said, “It wasn’t as effective as I thought it was going to be.”

The FDA was informed of the unauthorized sales through an anonymous call. Paige Peterson, a former LipoTron distributor, and Belinda W. Worley, a marketing consultant who worked with her, told FairWarning they dialed in from a hospital phone in hopes the call could not be traced.

But they agreed to meet with criminal investigator Evan Rae a few days later at a Hilton inn in Waco, mid-way between Rae’s office in Austin and Dallas, where Peterson and Worley lived.

They found a quiet spot  in the lobby bar, which was closed in the morning, and talked for a couple of hours. Peterson said she gave Rae a detailed statement, a computer flash drive and copies of records, including emails, memos and invoices. Rae taped the conversation and snapped photos of the LipoTron 3000 the women had brought along. Rae declined to be interviewed.

Peterson told FairWarning she had made 39 LipoTron sales, even though she was aware the device had not been cleared by the FDA. The evidence she gave Rae “was just as damning of me as everybody else. I have zero assurances that the FDA is not going to arrest me.”

Peterson admitted there was no love lost between her and Reveco. She said she had paid out-of-pocket for some research costs aimed at getting FDA approval, but had not been reimbursed. And she said the company dumped her as a distributor in favor of another sales group.

But Peterson also said Reveco had misled her with repeated assurances it was taking all proper steps and FDA approval was imminent—and spread this misinformation to some anxious customers.

“I had run out of acceptable answers to give the doctors that had purchased the LipoTron,” she said. “I needed to fall on my sword and tell the truth.” Better to come clean, Peterson decided, than to wait for the FDA “to come knocking on my door.”

While declining to comment on Peterson’s statements, Rosen said she had gone over to “the dark side.”

“She’s a person that’s vindictive,” he said. “She’s doing it out of spite.”

For her part, Peterson says that after 2½ years she is surprised and frustrated by the apparent lack of action.

“Why do we have an FDA?” she asked.

“I tried to do what I thought was right, and nobody’s doing anything about it. Everybody gets to thumb their nose at the law.”

Israeli jailed for illegal US kidney transplants

An Israeli convicted of arranging US kidney transplants for profit has been given a two-and-a-half-year sentence.

Levy Izhak Rosenbaum admitted brokering kidney transplants for profit, becoming the first person convicted over illegal organ sales in the US, prosecutors say.

He was alleged to have charged between $120,000 (£77,400) and $160,000 to arrange kidneys for three people.

He was caught trying to arrange fourth operation when the FBI launched a sting operation in 2009.

New Jersey prosecutors said Rosenbaum, an Israeli living in Brooklyn, used newspaper adverts in his homeland to find donors willing to give up a kidney in return for cash.

He was alleged to have paid as little as $10,000 to secure a donor organ.

He then helped set up blood test and services to ensure a proper match was arranged for those in need of a transplant in the US.

‘The cause was good’

Although at least one recipient of a kidney spoke up in defence during Rosenbaum’s sentencing hearing, one other said they had felt exploited.

“It was wrong, but I thought the cause was good,” Rosenbaum, 61, told the court.

“I can assure this court I will never do this again.”

Prosecutor Paul Fishman said Rosenbaum was motivated by profit, not by a desire to heal the sick.

“A black market where the moneyed sick can buy replacement parts from the less fortunate is not only grim, it apportions lifesaving treatments unfairly, insults donor dignity, and violates the law,” he said in a statement.

“Although Rosenbaum painted himself as a benevolent kidney matchmaker, the criminal profits went right into his pocket,” Mr Fishman added.

But those who spoke in support of Rosenbaum described him as a devout Orthodox Jew who was dedicated to helping people.

“There are no victims here,” Rachel Warshower, who travelled from Brooklyn to support Rosenbaum, told the Associated Press.

“The donors are happy and the recipients are happy. Izhak Rosenbaum is not the monster the media has made him out to be.”

Blaylock explains how fluoride opportunists seized upon falls in dental cavities, which were occurring naturally as a result of increased calcium intake and better diets in the west, to claim that mass fluoridation was the answer, while burying a plethora of studies that proved adding fluoride to water did not reduce cavities at all and in fact in several instances increased dental cavities.
Blaylock highlights how independent study after study has shown that fluoride increases cancer rates, increases bone disorders, which as Blaylock points out is a good way of increasing mortality rates amongst the elderly, and also leads to profound neurological disorders. Blaylock highlights the research of Phyllis Mullenix, Ph.D, who during her tenure at Harvard University conducted one of the largest studies into fluoride’s effects on the brain in animals. Mullenix found that offspring of animals who had been fed fluoride became hyperactive (ADHD) and that if you gave an animal fluoride after birth they became very lethargic and apathetic. Mullenix discovered that fluoride tends to accumulate in the part of the brain that controls behavior. After revealing the truth about fluoride, Mullenix was later shunned and attacked by the medical establishment that she had once been a part of.

Blaylock delves into the dangers of vaccines and how they are part of the eugenics assault, pointing out that America’s infant mortality rates are impossibly high for a nation that is supposed to be a global leader in health care. Blaylock puts the number down to the fact that American babies are now being shot up with more vaccines than ever before, the rising number of which correlates exactly with levels of infant mortality. “When you over-vaccinate, it interferes with the development of the brain and then the child has difficulty learning, they have behavioral problems, and their brain cannot develop normally,” states Blaylock.

This is a key interview to watch if you want to get a firm grasp of how we are under attack from modern day eugenics. The ongoing drought has river levels along the Mississippi River plunging to very low levels this summer and could stall barge traffic in some areas into the autumn if rainfall does not come soon.

It was just last year when levels along the Mississippi River and many of its tributaries were close to record high levels. What a difference a year makes.

Falling river levels are not uncommon during the summer months in the central and eastern United States. However, the building drought over much of the middle of the nation currently has the mighty Mississippi running well below normal and levels in many areas are likely to fall through much of the summer, unless widespread rain comes.

River levels along stretches of the Mississippi were already beginning to cause minor problems below the Ohio River junction.

Very low water levels expose shoals, potentially putting river traffic at risk for getting stuck in the mud.

Sandbars have been exposed at Vicksburg, Miss.

Officials in some areas are considering one-way traffic along portions of Old Man River.

According to National Weather Service (NWS) Hydrologists river levels along parts of the Mississippi River are 30 to 50 feet lower this year, compared to around the same time last year.

While significant rain is forecast to fall by AccuWeather.com over portions of the Ohio and Tennessee river tributaries and in part of the Mississippi Delta in the coming weeks, a lack of rain will continue over the Arkansas, Missouri and Upper Mississippi rivers for much of the summer.

Barge traffic from near Cairo, Ill. to St. Louis could potentially be impacted, if river levels get much lower due to the lack of rain in areas north and west of the intersection of the Ohio and Mississippi rivers.

According to NWS Hydrologist Steve Buan, at the North Central River Forecast Office, “River levels over the Upper Mississippi River are not ‘yet’ extraordinarily low.”

Buan commented that heavy rain in recent weeks from around Minneapolis to southwest of Duluth was keeping the river levels from reaching extremely low levels to this point, but that could change if days of steady rain do not come soon or thunderstorms make daily visits to the upper part of the basin.

As of July 13, the river level at St. Louis is 5.3 feet and falling and is projected by NWS Hydrologists to dip to under 2.0 feet around July 20.

According to St. Louis Army Corps of Engineers Public Affairs Chief Mike Peterson, “At the low water reference point of minus 3.5 feet, a safety zone is established in the navigation channel and some restrictions by the United States Coast Guard may be put in place.”

The river bottom of the Mississippi is dynamic, always changing so that barge companies and pilots will police themselves until mandatory restrictions are in place.

“Officials will continue to patrol the river and may undertake dredging operations as necessary,” Peterson said.

The Mississippi River drains more than 40 percent of the United States and has the Arkansas, Illinois, Missouri and Ohio rivers as some of its major tributaries, all of which are experiencing abnormally low levels.

Compare the Mississippi River basin to the amount of real estate experiencing abnormally dry and drought conditions this summer.

River levels along the Mississippi as of July 13, 2012 include: 12.2 feet at Thebes, Ill.; 5.3 ft. at St. Louis, Mo.; 5.2 ft. at Vicksburg, Miss. and -4.8 ft. at Memphis, Tenn.

As a point of reference, on July 13, 1988, the river level at St. Louis was -1.0 ft.

Simply put, a negative river gauge reading can occur as the river bottom condition changes from natural causes or dredging.

Exceptionally heavy rains have killed at least 19 people and flooded hundreds of houses on the southern Japanese island of Kyushu, the local authorities said Friday. The intense rainfall in certain areas of the prefectures of Kumamoto and Oita has attained levels “never experienced before,” the Japan Meteorological Agency said. In one part of Kumamoto, the equivalent of one month’s rain fell in the space of just eight hours early Thursday, according to the meteorological agency. Besides the 19 people who died — some of them in landslides and houses that collapsed — eight people are missing, according to information posted on the websites of the local prefecture offices and fire services. The violent rain has damaged 75 houses and flooded more than 500 in the two prefectures, the local authorities said. Evacuation orders were temporarily issued for tens of thousands of households as the Shirakawa River, which runs through Kumamoto City, began spilling over its banks. Helicopters plucked some residents from the roofs of their homes. Most of the evacuation orders had been lifted by Friday morning. Kyushu is the third largest island of Japan, located southwest of the main island, Honshu.

Even by Alaska standards, the rock slide in Glacier Bay National Park was a huge event. It was a monumental geophysical event that was almost overlooked until a pilot happened to fly over where the cliff collapsed and snapped some photographs nearly a month later. When the cliff collapsed in the national park in southeast Alaska on June 11, it sent rock and ice coursing down a valley and over a lovely white glacier in what perhaps was the largest landslide recorded in North America. The rumbling was enough so that it showed up as a 3.4-magnitude earthquake in Alaska. The seismic event also was recorded in Canada. The massive landslide occurred in a remote valley beneath the 11,750-foot Lituya Mountain in the Fairweather Range about six miles from the border with British Columbia. “I don’t know of any that are bigger,” Marten Geertsema, a research geomorphologist for the provincial Forest Service in British Columbia, said Thursday, when comparing the landslide to others in North America.If someone had been standing in front of the slide, the air blast alone would have flattened that person, said Geertsema, who studies natural hazards resulting from geophysical processes on the earth’s surface. “I think they would be blown over by the air blast,” he said. Despite the extraordinary size of the landslide, which was estimated at a half-mile wide and 5 1/2 miles long, it went virtually unnoticed until air taxi pilot Drake Olson flew over it on July 2. The landslide, which rolled over the glacier, is not very noticeable to the thousands of cruise ship passengers that visit Glacier Bay National Park near Juneau each summer. That is because it is about 12 to 15 miles up the glacier from the bay. While this one was huge by North American standards, bigger ones have occurred, including a September 2002 landslide in Russia that extended for 20 miles, Geertsema said. Lituya Mountain has been the scene of extraordinary geophysical events before. In 1958, a landslide on the other side of the mountain produced a wave estimated at 1,700 feet.

One fishing vessel was able to ride out the wave. “They looked below them and they could see the tops of the Sitka spruce trees way below them. The other boat disappeared,” Geertsema said. Another boat with two people aboard disappeared. One of Olson’s photos of the June landslide shows a huge dent in the side of an ice-covered peak. Another shows a river of rock and ice that flowed out of a valley. The landslide triggered numerous avalanches. Glacier Bay National Park Superintendent Susan Boudreau said visitors to the 3.2-million acre park won’t notice anything different in the landscape this summer, but the rock and ice likened to a river of black syrup moving toward the bay is on the move. How fast it is moving is still the question, she said. “It is going to come down but we don’t know the speed of that,” Boudreau said. There are several factors that contribute to the likelihood of mountains collapsing, Geertsema said. Sometimes it is caused by a general weakening of the rock. Other times it could be due to a very large snowpack that melts quickly. Scientists also are looking at the role of climate change. “We are seeing an increase in rock slides in mountain areas throughout the world because of permafrost degradation,” Geertsema said. Permafrost is ground that stays perpetually frozen. Geertsema said Swiss scientists are becoming increasingly convinced that climate change is playing a role in the frequency of rock slides after looking at data from instruments measuring temperature and the widening and narrowing of gaps in the rocks in the Alps. “It plays an important role,” Geertsema said, of climate change. “I think we have been underestimating the role it might play.” Park ecologist Lewis Sharman said the landslide is a reminder of why Glacier Bay National Park is special. “These types of events to me are welcome reminders that this place is one of the coolest on earth,” he said.

Industrial crews were trucking to the scene of a destructive landslide in southeastern British Columbia Thursday night to help search for four possible victims who may have been buried in a slide that rolled over three homes. A frantic search for the missing residents by emergency crews began shortly after 11 a.m. in the tiny community of Johnson’s Landing, 70 kilometres northeast of Nelson. Emergency officials said the three homes caught in the slide were “severely impacted” as the muck and debris gave way in a deluge from Gar Creek above the homes.The slide cut a large scar down the hillside, scattering trees like toothpicks and sending a torrent of mud into the nearby Kootenay Lake. It’s not yet known whether the people were in the homes swept up by the slide. “RCMP and search and rescue emergency responders on the site are trying to determine whether they were out of the community or in their homes. We don’t know that information,” said Bill Macpherson, a public information officer with Central Kootenay Regional District. “It is a very remote area, there is no cell service and we’re waiting to get back more definitive word,” he said of the unfolding situation.Seven workers were dispatched from nearby Castlegar to erect two towers of emergency lighting and two portable toilets so that rescuers can work as long as necessary. “From everything I can put together, it sounds like a fairly big slide – more than a piece of the roadway washing out,” said Kevin Chernoff, general manager of Trowelex Rentals and Sales. “It sounds like a piece of the mountain came down.” The crews are setting up in an area 20 kilometres away from ground zero. “The site is very congested and still very unstable,” Mr. Chernoff said. Multiple helicopters, two search-dog teams, under water recover divers, a landslide expert and a geotechnician have also been dispatched to the scene to help in the search and recovery effort. Mr. Macpherson couldn’t explain why the earth gave way. “It’s been sunny and warm, so (the slide was) somewhat unexpected,” he said. “I don’t have any cause or reason for why the landslide occurred.” The slide occurred at the end of the road on the north arm of Kootenay Lake. Last month, the lake reached its highest peak in 40 years due to heavy rainfall and accumulation of run-off. But Mr. Macpherson said at this point he doesn’t believe there’s any connection. An emergency operations centre is being set up in the city of Nelson.

Cuban health officials recently announced that the number of confirmed cholera cases in the nation has risen from 85 to 110. Residents in Granma province, the area hit hardest by the outbreak, have been advised to avoid traveling in order to stem the outbreak. A dissident journalist in Santiago de Cuba, the island nation’s second largest city, recently reported that hospital workers informed him of eight cholera deaths in the city’s hospitals. Havana has only confirmed three cholera-related deaths and claims the outbreak has only spread outside of Granma province in isolated cases. On Monday, Granma-based epidemiologist Ana Maria Batista reported on provisional television that there were 85 cases of the waterborne illness. Within 24 hours, she upped the number to 110. She added that the number of reported cases of diarrhea and vomiting, the symptoms of cholera, rose by 308 to 4,415, but that those hospitalized with such symptoms fell from 112 to 81. Batista also repeated the government’s claim that the outbreak was fully under control. Independent journalist Walter Clavel said that doctors in Santiago said authorities were insistent on not attributing any deaths to cholera and had advised them to put anything else on victims’ death certificates.

Climate change means stressed cows may have less milk

The temperature at which cows start producing less milk varies across the country depending on other factors like humidity and overnight temperature swings.

“Cows are happy in parts of Northern California and not in Florida” is a good way to sum up the findings of new research from the University of Washington, said Yoram Bauman, best known as the “stand-up economist.” Bauman and colleagues found that the decline in milk production due to climate change will vary across the U.S., since there are significant differences in humidity and how much the temperature swings between night and day across the country.

For instance, the humidity and hot nights make the Southeast the most unfriendly place in the country for dairy cows.

Their study combined high-resolution climate data and county-level dairy industry data with a method for figuring out how weather affects milk production. The result is a more detailed report than previous studies and includes a county-by-county assessment – that will be available to farmers – of the impact climate change will have on Holstein milk production in the U.S. through 2080.

Bauman, who contributed to the research while teaching for the UW’s Program on the Environment and is now a fellow at the Sightline Institute, will present the findings during this week’s Conference on Climate Change, held on the UW campus.

Scientists and the dairy industry have long known about and studied the impact of heat stress on cows’ milk production.

“Using U.S. Department of Agriculture statistics, if you look at milk production in the Southeast versus the Northwest, it’s very different,” said Guillaume Mauger, a postdoctoral researcher in the UW’s Climate Impacts Group and co-author of the paper. “It’s reasonable to assume that some of that is due to the inhospitable environment for cows in the Southeast.”

Previous research into how climate affects cow milk production in the U.S. was either limited in geographic scope or was too simplistic, ignoring the impact of humidity, for instance.

But by using detailed climate data covering night and day across the entire country, the researchers made some interesting discoveries. For instance, in Tillamook, Ore., where the climate is humid and the nighttime temperature doesn’t change much, milk production begins to drop at a much lower temperature than in the dry Arizona climate.

Tillamook cows become less productive starting at around 15 C, or 59 F, while those in Maricopa, Ariz., start making less milk at around 25 C, or 77 F. In humid Okeechobee, Fla., cows become less productive at about the same temperature but losses increase at a much faster rate than in Arizona.

Fortunately for cows in Tillamook, however, the temperature there doesn’t stray upward often and so actual milk losses are negligible, the researchers said. In Maricopa, the mean daily losses in summer, when the temperature soars, reach nearly 50 percent.

The authors also found that dairy farmers are already clustering in the most comfortable areas for cows, such as the cool coastal counties of Washington state.

But the outlook isn’t good for areas across the southern U.S. where cows are already less productive in the heat of the summer.

“Perhaps most significantly, those regions that are currently experiencing the greatest losses are also the most susceptible: they are projected to be impacted the most by climate change,” the researchers wrote in the paper.

Still, there’s a notable silver lining in the report. While the researchers project that dairy production averaged across the U.S. will be about 6 percent lower in the 2080s than at the start of the century, other factors are likely to actually boost milk production even more.

“Management practices and breeding are on track to double milk production in Holsteins in the next 30 or 50 years,” Mauger said. “So while a 6 percent drop is not negligible, it’s small compared to other positive influences.”

The research could be valuable to farmers looking to evaluate the cost and effectiveness of methods for keeping cows cool. “You can pick up dairy cows and truck them elsewhere,” said Bauman, who noted that ranchers looking to expand could make decisions based on climate.

The researchers plan to make the data freely available so that farmers can look up their counties and find how the climate may affect their cows.

The researchers hope next to look at the impact climate has on other barnyard animals, such as pigs, and other effects, such as mortality rate, that rising temperature might have on cows.

Other co-authors are Eric Salathe, an assistant professor at UW Bothell and member of the UW’s Climate Impacts Group, and Tamilee Nennich of Purdue University.

A powerful solar flare was unleashed from a massive sunspot Thursday, blocking high-frequency radio communication in the Northern Hemisphere and producing the potential for auroras to rage across the northern United States.

The flare was rated as an X-class sun storm by the National Oceanic and Atmospheric Administration, which is the most powerful type of flare the sun can have.

A giant sunspot facing Earth, named Active Region 1520 by NASA officials, discharged the flare around 12:50 p.m. EDT. Joining the solar flare that burst on July 6 from another giant sunspot region – AR1515 – it’s the second major solar storm to impact Earth in less than a week.

“The sunspot hasn’t produced a lot of activity since it’s been around, so the potential was there for it,” said AccuWeather Astronomy Blogger Hunter Outten.

Outten said the NOAA predicted a 15 percent chance for an X-class flare to occur today, with an 80 percent chance for an M-flare to occur, which is one level lower on the solar storm strength scale.

By 5:30 p.m. EDT, communications around the northern pole regions were still nearly impossible, Outten said.

According to the NOAA’s Space Weather Prediction Center, geometric storm activity could occur from the coronal mass ejection on Saturday, July 14, around 9 a.m. EDT, and the effects will be minor to moderate. CME particles are made up of solar plasma that damage Earth’s electrical grid.

The last major geometric storm occurred this year on March 6, producing an R3-level radio blackout from the CME’s particles. These storms also have the potential to create surges in power lines and jumble GPS information.

“This is something that is called long-duration, which we haven’t had since early March,” Outten said. “We can expect a pretty high geomagnetic storm.”

However, the storms will also have a beautiful effect on the atmosphere.

According to AccuWeather Meteorologist Mark Paquette, “it may be the most impressive [aurora] showing in years.”

Paquette said to expect the northern lights to extend across the northern U.S. over the next few nights. The farther north you live, the better chance you have to see them, he said, so those in Washington, northern Plains, northern Great Lakes, upstate New York and northern New England should keep an eye out.

“At least 50 percent of the United States could have auroras in their backyards,” Outten said.

In a possible preview of the light show to come, bright auroras have been dancing over Earth’s south pole. Robert Schwarz took this picture on July 12th from the grounds of the Amundsen-Scott South Pole Station:

“Yesterday we had some of the best auroras I’ve seen,” says Schwarz.

Despite its high latitude, the South Pole is not always a good place to see the lights because it is often located in the “doughnut hole” of the aurora oval. July 12th was an exception: “Look carefully at the picture and you can see the actual Pole in the foreground” Schwarz points out.

NOAA forecasters estimate a 55% chance of strong polar geeomagnetic storms on July 14th when a CME is expected to crash into Earth’s magnetic field. More South Pole auroras could be in the offing.

Red Cross representatives say they’ve been treating as many as 200 people a day for jellyfish stings on Spain’s Costa del Sol. The most common type of jellyfish found on the Costa del Sol, the Pelagia Noctiluca, are hard to see, as they’re less than 2 inches in diameter. Also sighted frequently are Rhizostoma Pulmo, which can be as much as about 3 feet in diameter and weigh more than 6 pounds. Thousands of people have been treated for jellyfish stings along the Costa del Sol. Some people have used nets to catch the jellyfish, Red Cross representative said. Officials in boats caught nearly 4 tons of jellyfish this week. Those stung by jellyfish should seek first aid on the beach, then go to a medical center, officials say. The officials say jellyfish stings should not be washed in fresh water. On Spain’s shores, jellyfish tend to wash up during periods of low rainfall and when there’s a sudden rise in temperature and a decline in the number of turtles, natural predators of jellyfish.

An anthrax outbreak has left at least nine cows dead and 50 people on antibiotics in eastern Germany, authorities said on Friday. Experts fear the cause was infected dead animals buried where the cows were grazing. Police pulled one of the dead cows out of the Elbe river on Thursday. It had apparently fallen into the water after becoming separated from its 50-strong herd, which was being quarantined. The corpse floated some distance from Saxony-Anhalt into the neighbouring state of Brandenburg, where it was finally dragged out of the river by a team clad in protective gear. “The current of the river is so strong, that the chances of a human getting ill from going in the water are slim,” a spokeswoman for the Stendal area – where the herd was from. Chances of the bacteria being passed to other herds were also slim, said state vet Klaus Reimer. Transmitting the deadly spores was only possible through close contact, and the whole herd has since been isolated.

While the exact cause of the outbreak remains unknown, Heinrich Neubaue, head of the institute for bacterial infection and zoonotic diseases at the Friedrich-Loeffler Institute, said that the most common reason was animals grazing in a field where animals with anthrax have been buried. Because anthrax spores can live for decades, there was a chance that they could make it up through the ground and into the air.Hoofed animals such as cows, sheep and goats are particularly susceptible to the bacteria, which can cause large sores, inflammation of the throat, nose and tongue, and often sudden death. An investigation will start on Monday to see whether dead animals are in fact buried where the affected herd grazed. In humans, the bacteria is most commonly contracted by those who work closely with animals. Some 50 people thought to have come into contact with the cows prior to the outbreak have now been put on preventative antibiotics. Approximately 2,000 people die of anthrax each year worldwide, according to World Health Organisation statistics. Bureau of Fisheries and Aquatic Resources (BFAR) Bicol director Dennis Del Socorro released a report that Red Tide toxin in contaminated shellfish has caused the death of a 5- years old child and caused 12 other residents of Sitio Bongcana, barangay Paraiso in Milagros, Masbate to be hospitalized from poisoning. In an effort to curb the transport of contaminated shellfish out of Milagros, BFAR reinstalled check points in main highways in Masbate province. Shellfish is a major fishery product in Milagros town. According to Del Socorro, since June 17 this year BFAR experts have conducted tests in sea waters of Milagros, revealing that Red tide toxin levels have increased by 282 uni-micro-grams in every 100 grams of shellfish meat that were tested. Although a more recent test confirmed that toxin levels decreased to 263 uni-micro-grams, still experts consider this fatal to humans who eat contaminated shellfish,. Meanwhile, BFAR has declared that neighboring waters of Mandaon, Masbate, Sorsogon Bay, and Juag Lagoon in Matnog Sorsogon are still free from Red tide.

Bees in the cavity of a fallen tree gained the upper hand against a City of Palo Alto tree-removal crew on Wednesday afternoon, stinging the entire crew of five. The Public Works Department employees responded when a large, silver maple with extensive root rot fell down onto Newell Road. When they arrived, they found that a beehive in the tree’s cavity had been damaged, said city Urban Forester Walter Passmore. And the bees were furious. “The entire crew got stung at least one time per person. Some were stung multiple times. They looked like they got in a fight. They all paid the price for working for the City of Palo Alto,” he said. Workers were trying to cut up the tree, which was blocking the road in front of 2020 Newell. The city called a bee service to try to capture the hive; bees will generally follow the queen into a box if the portion of the hive where she is located can be removed. But Passmore said because part of the hive was broken the bees would not calm down. The hive eventually had to be exterminated, he said. Crews finished cleaning up the tree Thursday, July 12. Another large silver maple of about the same age is growing under the same conditions and is just 40 feet to the north of the fallen tree. It will be evaluated to make sure it does not pose a hazard, Passmore said.

France sends emergency anti-locust aid

France said this week it is mobilizing emergency efforts to stop locust swarms in Africa’s Sahel from spreading farther into drought-stricken Niger and Mali.

The French Foreign Ministry said Tuesday it had released $1 million in emergency funding targeted to Niger — the country currently most affected — through a contribution to National Center for Locust Control in Mauritania.

Part of the funding will also go to help in a regional response to the locust swarms though an emergency fund set up by the U.N. Food and Agriculture Organization.

The latter effort will be aimed at surveying and controlling locust in Mali, where militant Islamists and Tuareg rebels have used the chaos created by the March overthrow of President Amadou Toumani Toure to seize control of the northern part of the country.

“Groups of desert locusts have been identified in recent weeks in the northern part of the Sahelian strip by the surveillance system set up by the countries of the region,” the French ministry said in a statement. “These groups were notably found in northern Niger and Mali where insecurity could hamper the necessary survey and control operations.”

The spread of this locust invasion to the southern part of the Sahel region, Paris said, “would have disastrous consequences, resulting in the loss of crops and the prospect of a worsening food crisis.”

The ministry said the swift mobilization of donors, notably France and the EU, “has already made it possible to cover, within a few days, the immediate needs, estimated by the FAO to be $2.5 million.”

“France will remain particularly attentive to developments in the situation in the weeks and months ahead.”

The Commission for Controlling the Desert Locust in the Western Region, an inter-regional FAO committee working with 11 countries in North Africa and the Sahel, has indicated it plans to double its efforts to stop the plague, France24 reported.

Swarms were first spotted in northern Niger in May, but efforts to keep them from reproducing were hampered by the fact that heavy rainfall earlier in the year had created ideal breeding conditions.

Despite the control efforts, swarms of the insects are moving south into Niger’s agricultural breadbasket, where around 1.2 million acres of crops are at risk of being destroyed.

The unrest in northern Mali has meant FAO efforts to control the locust swarms from spreading there have been brought to a halt.

Swarms of immature locusts have invaded the Kidal and Aguelhok regions in northern Mali, sparking concerns the insects may devastate the country as it reels from drought, conflict, and the displacement of more than 360,000 refugees from the fighting, the United Nations has warned.

“It is difficult to know exactly how the situation is, as it is not safe to send scientific teams there,” Manda Sadio Keita, an FAO program officer, told the U.N. news service IRIN. “We cannot assess and fight locusts anymore.”

The government of Mali estimated in April almost 3 million people were living in conditions of food insecurity in drought-affected areas, while the FAO has since pegged the number at 1.6 million people throughout the regions of Gao, Kidal, Timbuktu and parts of Mopti, Voice of America reported.

Emergency responders and hazardous materials crews are on the scene at Lion Dunc Schooley Pool in St. Catharines where a large chlorine leak occurred Thursday afternoon, sending at least 12 people to hospital. Apparently, two chemicals mixed together, causing a reaction. The Niagara Health System reports six people are at St. Catharines General Hopsital, four in stable condition and two serious, while four more are at Greater Niagara General Hospital in Niagara Falls, all stable, and two more are on the way to GNGH. Initial symptoms include difficulty breathing. Police have blocked traffic to Seymour Avenue from Hartzel Road. The pool is located at 32 Seymour Ave. in Merritton. Donald MacLellan, was there with his seven-year-old niece, Vanessa, visiting the pool for the first time today. He said they were in the kids pool but were told to move to allow for the chlorine levels to be checked. “We were in the larger pool maybe three minutes and then there was a wave of it (cholorine),” he said, noting you couldn’t really see anything. “The smell – I tell you. I’ve breathed it in…. and you start choking,” he said.

“It cuts your breath at first, then it seems to burn the throat and chest area.” He said it also caused a headache. MacLellan had left the scene as he and his niece are asthmatic and required puffers for their breathing, but when they saw the fire department respond they turned back and were treated. “It was closer for us to get to them,” he said. Firefighters provided oxygen for Vanessa, and the pair were later washed down by firefighters, who were decontaminating those affected. MacLennan said that by his estimate, there were about a dozen swimmers in the pool, along with four or five lifeguards. The area of Merritton area around the pool will be shut down for next three to four hours as gas is still leaking into the air. Emergency responders are also set up at St. Catharines General Hospital for a secondary decontamination before patients are admitted into the emergency rooms. Initial reports suggested police were preparing to evacuate residents in the area. However, they are being told to stay inside with their windows shut as a precaution. The pool will need to be drained and cleaned before it is used again.

Trigger for past rapid sea level rise discovered

The cause of rapid sea level rise in the past has been found by scientists at the University of Bristol using climate and ice sheet models. The process, named ‘saddle-collapse’, was found to be the cause of two rapid sea level rise events: the Meltwater pulse 1a (MWP1a) around 14,600 years ago and the ’8,200 year’ event. The research was published in Nature this week.

Using a climate model, Dr Lauren Gregoire of Bristol’s School of Geographical Sciences and colleagues unearthed the series of events that led to saddle-collapse in which domes of ice over North America became separated, leading to rapid melting and the opening of an ice free corridor.

Evidence of these events has been recorded in ocean cores and fossil coral reefs; however, to date the reason behind the events was unclear and widely debated.

Ice domes up to 3 km thick (three times the height of Snowdon), formed in regions of high snowfall and higher topography, such as the Rocky Mountains. Together with the saddles – lower valleys of ice between the domes – these made up the ice sheet.

Towards the end of the last ice age, at the time of mammoths and primitive humans, the climate naturally warmed. This started to melt ice at increasingly high elevations, eventually reaching and melting the saddle area between the ice domes.

This triggered a vicious circle in which the melting saddle would lower, reach warmer altitudes and melt even more rapidly until the saddle had completely melted. In just 500 years, the saddles disappeared and only the ice domes remained.

The melted ice flowed into the oceans leading to rapid sea level rises of 9 m in 500 years during the Meltwater pulse 1a event 14,600 years ago and 2.5 m in the second event, 8,200 years ago.

Dr Gregoire, lead author of the study, said: “We didn’t expect our model to produce such a rapid sea level rise. We got really excited when we realised that the events we simulated corresponded to real events!”

In the model, Dr Gregoire found that saddle-collapse could explain a significant amount of the sea level rise observed: “The meltwater pulse produced by the saddle-collapse can explain more than half of the sea level jump observed around 14,600 years ago. The rest probably came from the progressive melting of ice sheets in Europe and Antarctica.”

This research not only identifies the process which caused the melting of the North American ice sheet and the trigger for rapid sea level rises in the past, but also increases our understanding of the nature of ice sheets and climate change, allowing further questions to be posed and, with more research, answered.

Research like this allows climate and ice sheet models to be tested against evidence from the real world.

If climate models are able to reflect patterns observed in natural records our confidence in them increases. This is particularly relevant where the models are also used to investigate the effect of climate change on ice sheets in the future.

The study was funded by the NICE Marie Curie Research Training Network and the Natural Environment Research Council (NERC), and the numerical model simulations were carried out using the facilities of the Advanced Computing Research Centre (ACRC) at the University of Bristol.

E. coli Outbreak Sickens 10 in Germantown, Ohio

ecolifromusda-featured.jpgWhioTV has reported that at least 10 people have fallen ill with E. coli infections after eating at a picnic in Germantown, Ohio, according to the Dayton & Montgomery County Health Department. Approximately six people have been hospitalized, a health department spokesman said.

The exact source of the bacteria is unknown, and information on the strain has not been published. Further inquiries to the health department have not been returned as of press time.

Those ill attended a company picnic featuring 200 to 300 people. More attendees could have fallen ill who have not yet sought medical attention or been counted, the health department said.

Sixty-One Now Sickened with E. coli 0157 in Neff’s Lawn Care Picnic Outbreak

According to Bill Wharton, spokesman for the Dayton & Montgomery County Health Department in Ohio, 61 people have been sickened with E. coli 0157 after attending a picnic held by Neff’s Lawn Care in Germantown. Mr. Wharton said that 11 people have been hospitalized. Mr. Wharton said, “we aren’t releasing any information other than to say we’re investigating the outbreak.” The health department is interviewing picnic attendees and patients, looking at food sources, storage and handling practices, and cross-contamination potential.

Since 200 to 300 people attended the picnic, more cases may be reported. Doctors must report E. coli infections to public health officials. If you or anyone you know attended this picnic and have been sick, please call the Dayton & Montgomery County Health Department at 937-225-4460 to talk to a public health official.

Symptoms of E. coli infections include severe stomach cramps, diarrhea which is often bloody, a mild fever, and sometimes nausea and vomiting. E. coli 0157 infections cannot be treated with antibiotics, since that increases the risk that hemolytic uremic syndrome, a serious complication, may occur.

 

Federal Egg Safety Rule Goes into Full Effect

The government’s Egg Safety Rule, a set of requirements designed to prevent Salmonella contamination at laying facilities, became fully fledged Monday when it went into effect for medium-sized operations after previously applying only to large producers.
Since July of 2010, companies with over 50,000 laying hens have been required to comply with these standards – set forth by the U.S. Food and Drug Administration in 2009 – but as of yesterday the rule now covers facilities with more than 3,000 and less than 50,000 hens.
These regulations do not apply to small producers – those with under 3,000 hens – or companies who sell directly to consumers. A separate guidance was issued for these facilities in 2010.
The rule requires all producers who don’t pasteurize in-shell egg products to test for Salmonella Enteriditis bacteria and to refrigerate eggs at 45 degrees F or less during storage and transportation, starting within 36 hours of when they are laid.
It also says that chicks and young hens may only be sourced from suppliers who monitor for Salmonella. Companies must implement biosecurity, rodent and pest control measures.
According to the rule, if Salmonella is found on eggs or in a laying facility, the eggs must be pasteurized or diverted for non-food use, and the facility must be sanitized.

Georgia Food Processors Get To Dance Around Law

Despite a tough new food safety law and more than a half million spent annually on inspections and lab work, Georgia is not achieving the food safety improvement at the state’s 740 food processing plants that its lawmakers seek.
Perhaps, some say, Agriculture Commissioner Gary Black did not get the memo about how serious the Georgia Legislature is about not wanting a repeat of the poison peanut butter produced three years ago by a plant in Blakely, GA.
Black, a former president of the Georgia Agribusiness Council, was elected after the Peanut Corporation of America plant produced peanut butter and peanut paste contaminated with Salmonella, killing nine people and sickening hundreds of others nationwide.
Georgia lawmakers reacted to the outbreak by passing a law requiring the state’s food processors to conduct regular internal pathogen tests and report any positive results to the Department of Agriculture now led by Black.

But in a performance audit released on June 29, the Georgia Department of Audits and Accounts found that just seven positive results were reported during the first 30 months of the program.
As soon as the audit hit the street, Black said he was taking steps to revamp inspections and testing.
“To improve its overall effectiveness and efficiency,” the audit says, “the department should develop a risk-based inspection process.”

The inspection unit’s goal is to conduct a routine inspection of each processing facility every six months.

Study: Farmers Market Employees Rarely Wash Hands

Employees serving ready-to-eat food at farmers markets may be putting consumers at risk by not washing their hands, according to a recent study from Purdue University.
Researchers observed 18 workers at different Indiana farmers markets and found that none used proper hand washing techniques when cooking or serving prepared foods to customers.
Out of the 900 transactions noted by researchers, 417 required hand washing according to state health code; however, only two attempts at hand washing were made. An “attempt” was defined as rinsing hands but not using soap or drying hands with a disposable towel, meaning that it did not constitute proper hand washing behavior.
“Compliance was practically non-existent,” note the study’s authors.
The study also found that the more tasks one employee had to perform, the more occasions arose where hand washing was needed (and missed). The authors suggest that if labor was divided among employees and each had a specific task, that risk would be minimized.
Adding employees will not help solve this problem, says the study, since those employees could still have different jobs to do.
Farmers markets are becoming an increasingly popular food source. In 1994 there were an estimated 1,755 farmers markets nationwide. By 2009 that number had grown to 5,274, and between 2009 and 2010 it increased by another 16 percent, putting the total at 6,132. The following year, over 1,000 more were established.

New Brunswick Affected By Another E. Coli Outbreak

Health officials in the capital of the Canadian province of New Brunswick are trying to get ahead of an outbreak of E. coli O157:H7 that has put two teenagers the hospital.
A total of four confirmed cases are being investigated in Fredericton. The source of the bacteria remains a mystery.
Victoria Boer, mother of one of the hospitalized teens, told CBC News that health officials are going through her daughter Micaella’s bank statements to figure out where she ate in the days before she fell ill with an E. coli infection.

Hazelnut Safety Improves in Wake of Outbreak and Recalls

Three years ago, hazelnuts started to build up a bad safety record. It began with a recall of 29,861 pounds of shelled nuts for potential Salmonella contamination at the end of 2009, followed by a smaller recall of 75 pounds in January of 2010. Later that year, an E. coli outbreak linked to in-shell filberts sickened 8 Midwesterners over the holiday season.
Before this time, no recorded outbreaks had been tied to U.S. hazelnuts.
This series of events forced domestic hazelnut producers – 99 percent of whom are situated in Oregon’s Willamette Valley – to re-examine growing and shelling processes with an eye to making a safer product.

Since there are currently no industry-wide safety requirements for hazelnut production, individual producers wishing to improve product safety must make their own standards.
One company that has done this is Willamette Hazelnut Growers (formerly Willamette Filbert Growers), the company that recalled nearly 30,000 pounds of hazelnuts in the winter of 2009 after Salmonella was found on nuts processed by its shelling operation.
The recall was particularly large because the company shells not only its own hazelnuts but also those of other area growers who don’t have shelling equipment.
“The recall was a huge setback for the processing business,” explained Operations Manager Michael Severeid in an interview with Food Safety News. “We had to buy everything back at full price and pay our customers. We had to ship it back and pay for the labor of collecting all of the products. It was very expensive.”

Upstate New York Shigella Outbreak Expands to 45

Almost three weeks after health officials in Upstate New York announced they were investigating a Shigella outbreak affecting 25 people, the estimated victim count has grown to 45.

The outbreak is affecting residents of Onondaga County, which includes the city of Syracuse and is located in the northern central part of the state.
“There are currently 45 cases of Shigella,” reported the Onondaga County Health Department in a statement to Food Safety News. “This includes confirmed, probable, and what New York State Department of Health is considering suspect (cases). We continue to investigate each and every case for linkages but the source remains unknown.”
Shigella infection is characterized by fever, stomach cramps and diarrhea that can be painful and contain blood or mucous. Symptoms usually appear 1 to 3 days after exposure and resolve in about a week.
The Onondaga County Health Department is urging area residents to take the following precautions to avoid the spread of Shigella, which is transferred through food or water contaminated with fecal matter carrying the bacteria.

FDA Found Violations of Food Safety Rules on 40% of Egg Farms

Hard cooked eggsThe FDA has released a new report on egg farms it inspected in 2011. They found violations of egg safety rules used to prevent Salmonella contamination on 40% of the inspected farms, but only 3% of the issues were serious enough for the agency to take action.

Last year, the agency inspected 555 egg laying farms. On 14 of those farms, or 2.7%, inspectors found “egregious” problems that called for an official response, such as an FDA warning letter.  An additional 195 inspections, or 37.9%,  found “significant deficiencies” the agency thinks farmers should be able to correct by themselves.

The problems include the following: lack of a written Salmonella enteritidis prevention plan; failure to test for S. enteritidis during required time periods; failure to divert or test eggs after a positive environmental sample; failure to implement the S. enteritidis prevention plan, Failure to maintain required records; and failure to monitor conditions required for the plan implementation.

Frozen Desserts Recalled for Undeclared Milk

A California company is recalling various frozen dessert products because they contain a product derived from milk, a known allergen, but milk is not listed as an ingredient.

Arctic Zero, Inc. of Escondido, CA has issued a voluntary recall of 16 oz. pints and chocolate dipped dessert bars produced before February, 2012. The products were made with whey protein, which is made from milk, but milk was not declared as an ingredient on packaging.

Carl Rittberger Sr., Inc. Recalls 9,000 Pounds of Deli Items for Listeria Risk

bolognalist-iphone.jpgOhio-based Carl Rittberger Sr., Inc. has recalled roughly 9,000 pounds of fully-cooked deli items because of a possible contamination of Listeria monocytogenes. No illnesses have been reported.

The following products purchased by retailers between June 25 and July 6 have been recalled:
Spiced loaf, breakfast loaf, garlic bologna, German brand bologna, wieners, grillers, kielbasa, straight HB roll and natural casing wieners.
The bacteria was found during routine testing by the Ohio Department of Agriculture. The product that tested positive never left the plant.

Winn-Dixie Recalls Cheeseburger Skillet Dinner for Small Metal Fragments

Winn-Dixie is announcing a recall of their store brand Cheeseburger Macaroni Skillet Dinners because the package may contain small metal fragments. The recalled Winn-Dixie Cheeseburger Macaroni Skillet Dinner product is in a 5.8 ounce package with a UPC number of 2114018080 and a sell-by date of May 14, 2013.  The recalled products were sold in Alabama, Florida, Georgia, Louisiana, and Mississippi.

The product was shipped to stores on or after May 14, 2012. There have not been any reports received of any injuries associated with the consumption of this product.

Cass-Clay Creamery Recalls Peppermint Bon Bon Ice Cream

Cass-Clay Creamery of North Dakota is recalling Hornbacher’s Peppermint Bon Bon ice cream for undeclared eggs, one of the major food allergens. The recalled Cass-Clay products include the following: Hornbacher’s Peppermint Bon Bon Light (Half gallon/1.89 liter), Schroeder Pepppermint Bon Bon (1.75 quart/1.65 liter) and SunnyBrook Peppermint Bon Bon Light (Half gallon/1.89 liter). The products were distributed in Iowa, North Dakota, Minnesota, and Wisconsin. All code dates are affected by the recall. No illnesses have been reported to date.

A flavoring containing egg yolks was used as an ingredient in the product. Return the products to the store where they were purchased for a full refund. For questions, call the Consumer Affairs line at 1-800-441-4269.

 

 

In Canada, Fresh Peas Recalled for Possible Listeria

The Canadian Food Inspection Agency is recalling fresh shelled peas from Thomas Bros. Farm Market because they may be contaminated with Listeria monocytogenes. The recalled fresh shelled peas were sold from Thomas Bros. Farm Market at 5856 Colonel Talbot Road in London Ontario on June 27, 2012. The packages do not have labels.

If you have purchased this product, do not eat it. If you have frozen the peas for later consumption, discard them. There have not been any reported illnesses associated with the consumption of this product. Food contaminated with dangerous bacteria may not look, taste, or smell spoiled. Listeria can cause listeriosis, which can cause symptoms of high fever, headache, neck stiffness, and nausea. NIH Study Finds Children With Allergies Have Frequent Reactions

A new study conducted at the Mount Sinai School of Medicine, part of the Consortium of Food Allergy Research at the National Institute of Health (NIH), has found that young children with milk or egg allergies have reactions more often than expected.

The research team followed 512 infants, ages 3 to 15 months, for three years. The children in the study had a previous allergic reaction to milk or eggs, or were thought to be allergic to those foods based on positive skin tests. At the beginning of the study, caregivers were given strategies for avoiding milk and egg products, and written emergency plans with epinephrine prescriptions.

The study found that almost 72% of the children in the study had an allergic reaction over the three year period. More than half of the children had more than one reaction. Startlingly, allergenic foods were given to the children on purpose.

Scientists aren’t sure why a parent or caregiver would give a child an allergenic food. It may be that they want to see if the child has outgrown the allergy. The study found that half of the accidental reactions were from food given to the child by parents, stressing the importance of making sure all caregivers, including siblings, babysitters, and teachers are aware of the allergies.

Mad Cow Disease Spreads in Nervous System Before Detection

Cows in the FieldA new study in the American Journal of Pathology has shown that bovine spongiform encephalopathy (BSE), commonly known as “mad cow” disease”, spreads in the autonomic nervous system (ANS) to the central nervous system (CNS) before it can be detected. Mad cow is a fatal disease in cattle that can be transmitted to humans who eat infected tissue. There isn’t much that scientists know about the spread of the BSE prion in its early incubation period. Other studies have reported that the autonomic nervous system was affected only after the central nervous system is infected.

The autonomic nervous system controls involuntary actions, such as heart rate, blood pressure, and the functions of major organs. It consists of the sympathetic ANS, the parasymphathetic ANS, and the enteric nervous system. The central nervous system is the part that controls your brain and makes up your consciousness; it consists of the brain and spinal cord. It usually takes five years from infection before the disease can be detected. But in the study, 56 calves were infected orally with BSE; samples were collected every four months for the next three and a half years. Scientists found the pathological prion (a misfolded protein that is not alive) in the gut and in the ANS but not in the CNS.

USDA Budget Cut Could Slash 80 Percent of Produce Testing

The nation’s largest pathogen testing program may shut down this month

Public testing for pathogens like E. coli, Salmonella and Listeria on fresh produce will drop by more than 80 percent if a key U.S. Department of Agriculture testing program is eliminated, according to an analysis by Food Safety News.

The USDA’s Microbiological Data Program was zeroed out in the Obama administration’s 2013 budget request and Congress is not seeking funding for the $4.5 million program next year. It is rumored that MDP is set to close down at the end of this month, but the Agricultural Marketing Service, where MDP is housed, would not confirm the program’s status.

Elimination of the testing program has become a public health hot potato. Several media outlets, including the Chicago Tribune, the Associated Press, and the New York Times have weighed into the debate. The Times’ editorial board even called it “a tiny program that matters,” an unusually high profile appeal for an obscure program with a relatively small budget.

This “tiny” program was launched in 2001 simply to collect data about fresh produce contamination, but it now regularly sparks produce recalls when participating state labs find pathogens. Perhaps more importantly, the labs upload any positive test results to the Centers for Disease Control’s PulseNet, which helps public health officials link foodborne illness cases to food products. MDP is also the only federal program that tests for non-O157 E. coli strains like the one that caused the deadly, high profile sprout outbreak in Germany last year.

Both the Obama administration and the fresh produce industry have argued that AMS is the wrong agency to house the nation’s only robust microbiological surveillance program for produce because AMS is focused on marketing, not food safety. Some believe the U.S. Food and Drug Administration, which has jurisdiction over the safety of produce, would be better equipped to screen produce for harmful pathogens.

FDA gave Food Safety News an overview of its surveillance testing from 2009 to 2012. The agency pulls, on average, 80 percent fewer fresh produce samples for testing than MDP. It is not clear whether FDA plans to, or has the resources to ramp up testing to fill the void that would be left by eliminating MDP testing. FDA did not respond to questions about whether the agency would ramp up testing next year.

As much as 50 to 60 percent of produce consumed in the United States is imported, depending on the season. The numbers below do not include testing FDA may do in the event of an outbreak, which can include product testing from outbreak victims or environmental testing from food facilities.

International School for Food Protection: 21st Century’s Food Industry Classroom?

The newly opened International School for Food Protection (ISFP) was developed to provide an environment different from traditional professional adult learning experiences.
A spokesman said, “The School management team recognizes that experienced food professionals are generally well-versed in their core scientific knowledge, academic education and work experiences. We want to build on their working food industry knowledge to strengthen the critical thinking, decision making and leadership skills that are essential to be an effective food industry professional.”
The ISFP uses Bloom’s taxonomy, a multi-tiered model of classifying thinking according to six cognitive levels of complexity, as the basis for its structured learning approach.
Throughout the years, these levels have often been depicted as a stairway climbing to a higher level of thought. The basic levels are knowledge, comprehension, and application. The highest levels are analysis, synthesis, and evaluation. Bloom’s learning objectives are used to define how well a particular skill or competency is learned or mastered.
To meet the complex food safety challenges facing the food industry, the ISFP curriculum was developed to go well beyond current education and training standards. Introductory courses are designed to allow students to learn the complex interdependencies that characterize the global food supply environment.  That knowledge serves as a building block to move to more advanced levels of learning.
Successive courses introduce students to the higher order thinking skills: analysis, synthesis and evaluation. Upon completion of the courses, students should gain a mastery of critical thinking, decision-making and the essential skills necessary to be an effective leader in the globalized food protection environment.
The ISFP curriculum is influenced by science and technology to reflect the changes taking place in the food industry.  It encourages people to look at old problems in new ways in order to find unique solutions. Courses teach the newest science- and risk-based methods and implementing technologies to help food enterprises increase their competitive advantage across areas including food defense, food safety, asset management and protection, bio-safety, information technology, critical infrastructure protection, business intelligence, risk management and organizational transformation.

Jensen Farms Cantaloupe Listeria Cases Must Be Filed by September 14

Jensen Farms, the company that grew and shipped the cantaloupes that caused the large Listeria outbreak last summer has filed for bankruptcy. The United States Bankruptcy Court in Colorado has approved the motion, and a date has been set for filing of claims.

All people who assert a claim based on the outbreak of listeriosis must file it by 5:00 pm Eastern Time on or before September 14, 2012. It’s important that anyone who was affected by this outbreak file a claim to receive compensation for their injuries. The court is ordering that Jensen Farms make available $4 million in settlement money, from its insurance policy, insurers of the equipment the facility used, and from the third-party auditor who failed to discover contamination at the plant just before the outbreak occurred.

The company faces seven personal injury lawsuits and 12 wrongful death suits. That outbreak was one of the deadliest in U.S. history, killing at least 35 people and sicking 146 in 28 states before the Centers for Disease Control and Prevention (CDC) declared the outbreak over on December 8, 2011 and released its final report. The outbreak began on September 2, 2011, when the Colorado Department of Public Health and Environment notified the CDC about seven patients who were sick with the same strain of Listeria bacteria.

Individuals and Companies Should be Prosecuted for Foodborne Outbreaks

As one of the few food safety lawyers in America, I’m often asked whether I believe that America’s food supply is the safest in the world. The short answer is: “I have no idea” – and if you’re one of the thousands of Americans sickened each year by foodborne illness, it’s no comfort knowing that some countries have food less safe than the product that shut down your kidneys or killed your loved one.

The real questions about food safety have nothing to do with overweening national pride. In fact, there are only two questions that make any sense at all: “Can our food system be safer?” and “What steps have to be taken to make it so?”

Since no one honestly doubts that our food safety system can and should be better, let me focus on answering the second question (based on what I’ve learned litigating the failures of companies implicated in foodborne illness outbreaks). I will address these issues in the weeks to come but begin with a deficiency I find particularly galling – the failure to prosecute individuals and companies responsible for outbreaks.

If while driving a car, I go too fast, take my eyes off the road or drive while intoxicated, and someone ends up paralyzed or dead, I’m going to be prosecuted. And I should be. So why should a food producer that ignores accepted principles of food safety (or, worse, the company’s own food safety systems) not have to fear criminal prosecution when scores of Americans are sickened or killed by the company’s egregious conduct?

I can think of a number of recent outbreaks – the Peanut Corporation of America Salmonella outbreak, the Jensen Farms Rocky Ford cantaloupe Listeria outbreak and the Wright County egg Salmonella outbreak – that may have warranted criminal prosecution. Sadly, it appears that, short of declaring a company’s intent to sicken as many folks as possible, miscreant food producers have nothing to fear.

California GMO Labeling Law Named Prop. 37

gmotomatoes-406.jpgCalifornia’s Office of the Secretary of State announced on Monday that the California Right to Know Genetically Engineered Food Act, also known as the GMO labeling initiative, will appear on voter ballots as Proposition 37 for the November 6 elections.

If passed, Prop. 37 would make California the first state in the U.S. to require labeling of most foods made with genetically modified organisms — those given specific changes to their DNA through genetic engineering techniques.

Polls conducted by various organizations in recent years have found that roughly 90 percent of Californians support labeling for genetically engineered (GE) foods. But regardless of the polls, leaders of California’s GE labeling movement are still preparing for a fight on the road to election day.

“We certainly have huge support, but we’re not taking anything for granted. There’s a big effort to fight it and we’re worried about the money that will be put toward that effort,” California Right to Know campaign spokeswoman Stacy Malkan told Food Safety News.

GE labeling is already law in nearly 50 countries, including China, Japan and each European state. Alaska requires labeling of GE fish and shellfish, making it the only U.S. state with any type of GE labeling law.

Earlier this year, three-quarters of U.S. Senators rejected a federal GE labeling bill. Nearly 20 states have had similar bills turned down in congress in the past year.
Most major food corporations oppose GE labeling, citing the U.S. Food and Drug Administration’s requirement that GE ingredients be labeled if they’re determined to exhibit a difference in nutritional value or level of safety.

FDA Takes Action Against WI Livestock Dealer for Drug Residues

In response to a permanent injunction filed by the U.S. Department of Justice on behalf of the U.S. Food and Drug Administration, a Wisconsin livestock company and its owner have entered into a consent decree of permanent injunction over alleged illegal drug residues in cows meant for human consumption.

According to the complaint filed, Dan Nolan Livestock LLC and its owner, Daniel W. Nolan of Bonduel, Wisc., did not maintain adequate animal treatment records concerning the drug treatment of food animals.

In a release on Tuesday, the FDA said its inspectors also found that the company and Nolan used “new animal drugs illegally, and did not adequately distinguish between medicated and non-medicated animals for sale for use as human food.”

U.S. District Judge William C. Griesbach of the U.S. District Court for the Eastern District of Wisconsin signed the consent decree on July 9, 2012.

“The FDA took the action because it is concerned about the sale of animals for human food that may contain levels of animal drugs and could have the potential for adverse effects on human health,” the agency said in a statement.

“Among other requirements, the company and Nolan must implement a system that identifies the source of each animal and whether the animal was medicated. The firm also must implement a drug inventory and accountability system and provide purchasers, receivers, and consignees with written statements describing how the animal was medicated, or stating that the animal was not medicated.”

“If the FDA finds that the defendants are not in compliance with the decree, the agency may require defendants to cease selling and delivering any food animals. Failure to obey the terms of the consent decree could also result in civil or criminal penalties.”

Wisconsin Sizzlers Vindicated in State Supreme Court

After 12 long years, litigation stemming from one week in July 2000 when 150 customers of Sizzler Restaurants in Layton and Mayfair, Wisconsin were infected with E. coli O157:H7 and causing the death of three-year-old Brianna Kriefall is finally over.
Michael Martin, spokesman for Excel Corp, says the company is “relieved this litigation has concluded.” Excel was Sizzler’s meat supplier.

Excel would have stepped forward and accepted responsibility for the outbreak instead of digging in its corporate heels.
The irony is that Cargill-owned Excel could have saved millions by settling sooner, according to Gordon.
Gordon, the San Diego-based attorney for the two Sizzler franchises, has been representing restaurants implicated in outbreaks since the precedent-setting Jack-in-the-Box case.
After the 2000 Sizzler outbreak, plaintiffs’ lawyers filed lawsuits on behalf of the sickened customers, including a wrongful death suit on behalf of Brianna Kriefall. It would take until 2005 for all these cases to be settled, but Sizzler payed all plaintiffs’ medical bills over the year following the outbreak, which took a lot of pressure off of the victims.
In the wrongful death lawsuit, the Kriefall plaintiffs settled for $10.5 million, including $8.5 million from Excel and $2 million from Sizzler & E&B, Sizzler’s management company.
The other 138 plaintiffs were paid from a $3.5 million E&B insurance fund based on the severity of their injuries. Another $1 million went to the Kriefalls.
Money paid out to the victims, however, came ahead of the jury trial which assigned liability, so Excel wasn’t on or off the hook yet. Contaminated beef tips were only part of the story, as restaurant workers had allowed cross contamination with salad bar items including watermelon. Brianna Kriefall had eaten only watermelon.
It would be up to the jury to sort out how the businesses involved divided up the costs.

Research Linking Chicken to Bladder Infections Gets National Attention

There is growing evidence that there may be a link between bacteria on meat and antibiotic-resistant urinary tract infections in people — and that link is starting to get high profile media attention.

On Wednesday, ABC ran a segment featuring the latest research on both Good Morning America and World News with Diane Sawyer, programs with a combined daily viewership of more than 10 million. ABC called the research “compelling new evidence of a direct link between the pervasive, difficult-to-cure human disease and the antibiotic-fed chicken people buy at the grocery store.”

Canadian researchers recently published a study in the Centers for Disease Control and Prevention’s Emerging Infectious Diseases journal that found genetic similarities between E. coli from animals sampled at slaughterhouses and the E. coli that causes UTIs and suggested that chickens were the most likely reservoir for the bacteria. Most recently, some of the same researchers published a study in the journal of Foodborne Pathogens and Disease that found retail poultry meat had the highest levels of drug-resistant E. coli.

Urinary tract infections (UTIs) are the second most common type of infection in the body, accounting for 8.1 million visits to health care providers in the United States each year and around $1-2 billion per year in health care costs. Around 85 percent of these infections are caused by extraintestinal pathogenic Escherichia coli, or ExPEC, which doctors long assumed came from patient’s own intestines. New research, however, has been looking at outside sources as potentially part of the problem.

“What this new research shows is, we may in fact know where it’s coming from. It may be coming from antibiotics used in agriculture,” said Maryn McKenna, a reporter for the Food & Environment Reporting Network, which worked with ABC news on their investigation. McKenna, a leading infectious disease journalist and the author of Superbug: The Fatal Menace of MRSA, penned an in depth piece for The Atlantic that also ran on Wednesday.

“The researchers contend that poultry — especially chicken, the low-cost, low-fat protein that Americans eat more than any other meat — is the bridge that allows resistant bacteria to move to humans, taking up residence in the body and sparking infections when conditions are right,” wrote McKenna. “Touching raw meat that contains the resistant bacteria, or coming into environmental contact with it — say, by eating lettuce that was cross-contaminated — are easy ways to become infected.”

SNAP Will Replace Food Lost in Disasters

Many who rely on the Supplemental Nutrition Assistance Program (SNAP) can be in real trouble when they lose food in a natural disaster. When the power goes out for more than four hours, perishable foods become unsafe to eat and must be tossed.

Food Poisoning Bulletin contacted the Food and Nutrition Service of the USDA and was told that anyone who lost food that was purchased with SNAP can request replacement coupons from their local human service office. Those requests are time-sensitive, so it’s important that recipients know about this program and act quickly. Foods that are eligible for SNAP benefits include breads, cereals, fruits, vegetables, meats, fish, poultry, dairy products, seeds for food and plants that produce food.
